Thanks for that clarification, but I think you may have missed part of my point, this is one of those cases that there is little option to correct the situation because of the time limits already in place.
Using your logic that would infer that airline on-time stats have improved dramatically since the legislation came into existance nearly ten years ago........... That is certainly not my experience.I Would Rather Climb A Mountain Than Crawl Into A Hole

We where delayed in September last year when our flight from Tunisia to Manchester was delayed over three hours. It was a Tunis Air flight. We found it very hard to get an explanation as to why the flight was delayed, however one of the airline staff eventually said it was because our plane was coming from Germany and there was a delay there possibly due to bad weather. Does this EU ruling for compensation only apply to EU airlines in such a situation.0

A non-EU airline flying from a non-EU airport does not come under the Regulation's regime, I'm afraid.

My flight from London to Mumbai was delayed 5hours 30min. They boarded everyone on time. The flight moved from the the gates towards the runway, midway pilot turned the flight back towards another gate then said there is ice on the wings, though we couldnt see any ice and weather was not as bad. after couple of hours when everyone questioned why was the engine being repaired, they said there is block in fuel valve need to be replaced. then we were served with meal, we were made to sit in the flight for 6 hours and finally it took of 6 hours late. we were served just one breakfast for rest of the 10 hour flight.
The airline says the delay was due to technical problem.
would I be eligible for a claim.

I have not heard from AirIndia even after repeated mails over last 2 months. The customer service just forwards my mail to higher officials after that I don't hear from them, should write to them saying I will approach small claims court.0
