  • Hi all,

    I've had a good look through the main guide on compensation, but I've not been able to clearly answer my query on there so I'm trying in the forum.

    I recently travelled from Birmingham to Melbourne via Dubai using Emirates with my wife.

    We paid for all of our flights under one booking. The booking was for Birmingham to Melbourne.

    Our flight from Birmingham => Dubai was fine and arrived on schedule.

    Our Dubai => Melbourne flight was supposed to then leave at 10:10. The passengers were all through the gate waiting to board and were told that there had been a problem with the plane and that we had to swap planes, and this would take approximately 4 hours. We were then sent back out of the gate with meal vouchers in hand to use within the departures terminal.

    Come 4 hours later, we had to wait over another hour until we were on board the plane.

    In the end, we reached Melbourne well over 5 hours later than we originally were scheduled.

    As my ticket was for Birmingham to Melbourne and my exit point was within the EU, should we be entitled to the maximum €600 compensation each for this significant delay?

    I think I've covered the important bits, let me know if there's any more information needed.

    In a word - no.

    Your connecting flight departed the EU on time and landed at the first non-EU destination on time and the delay occurred subsequent to that entirely outside the EU on a non-EU carrier.

    Do you have a source for this?

    They had a ticket for a journey from Birmingham to Melbourne, and reached their destination five hours late. Why is the change of 'plane relevant?

    I think this has been debated many times on here.

    my interpretation
    EU261/2004 does not refer to compensation for delayed journeys it refers to delayed flights. (there is only one reference to the word journey in the regulations and this is in the context of rerouting)
    The compensation amount is indeed calculated by the impact of the delay to the entire journey but the flight that caused the delay needs to be either on an EU airline or on a non-EU airline departing the EU

    examples I have seen
    flight 1 UK-USA airport (non-EU airline)
    flight 2 USA airport 1-USA airport 2 (non -EU airline)

    flight 1 arrives late by 90 mins and this in turn means flight 2 is missed so pax is put on later flight which arrives at final destination over 4 hours later than planned
    EU compensation does apply and €600 due (assuming the 90 minute delay was not EC) - examples on the US Airlines thread like this

    Flight 1 in on time but flight 2 is delayed arriving destination over 4 hours late
    no compensation as the flight which caused the delay to the final destination was totally outside EU on non-EU airline

    It seems the NWNF companies will not take on these cases

    I don't think anyone has a definitive link (it would be handy!) but to me the OP had 2 Flights and the affected flight does not qualify for EU261

    I think Caz' explanation is very helpful.

    I myself am not sure about this - I have rather assumed that the Folkerts judgement, which talks about the late arrival at the destination involving "directly connecting flights", makes no such distinction. Do I recall that Centipede said the ECJ has had a case referred to it to test this very point? Or am I misremembering?
