should write to them saying I will approach small claims court.

That is probably a good idea but only if you intend to actually do it. Not sure about AI but most airlines don't crumble just because they are "threatened" with legal action.

Speak to a no win no fee firm if you don't fancy doing it yourself.

not sure if I am posting in the right place

I flew Newcastle-Paris-Mexico with Air France
Paris-Mexico leg was delayed 8hs but we were moved to a later flight the following day. That flight was also delayed 5hs. We finally made to Mexico 28hr after the scheduled time.

I wrote to Air France and they now say that the flight was operated by Aero Mexico they have transferred the claim to them
Is this correct? I didn't book or pay my tickets to AeroMexico....

    thanks!

Irrespective of who you bought your tickets from or the flight number (many airlines have codeshare agreements) it is the actual airline that operated the flight that you make your claim to. If that was AeroMexico then that is who you claim from

Please don't double post. I answered this on your other thread. As I said there, enforcing a judgement against AeroMexico may be very difficult, unless they have a presence in the UK.

EDIT: Their UK "office" is in Lavender Hill, south London. But it looks like it's just a post office box number ...

Finally got a reply, they asked for proof of travel I sent them the letter from AirIndia with my travel details and delay.
But the letter says it's for insurance claim. I had never mentioned in my request letter it's for insurance claim, I had just asked for travel confirmation and delay.
Now they have mailed me I took letter for insurance claim and I cannot claim from 2 agency.
I have mailed them back saying I have not claimed from insurance agency and it does not cover delayed flight, that's the reason European law asks airline to compensate and I had never mentioned in my letter it's for insurance claim.
Can someone please help me how to about with this further, they have not replied after this.

    Kind Regards

This was my reply to your post 2 days ago. It still stands.

But do you think since they have issued a letter stating it's for insurance Claim though I asked only travel details will it affect my compensation claim,

No, I don't think it makes any difference at all. You can't be denied your rights under the EU Regulation - well, not without your absolutely explicit consent, which you haven't given.

As far as I am aware, you can make a claim on your insurance in addition to an EU claim, subject to whatever your insurance may have to say on the matter.
