Flight delay compensation, all other non-EU airlines

Hi
It was only about 30/45 mins late arriving at Doha but we were denied boarding on to the connecting flight.
So this meant arriving at final destination of connecting flight around 8 hours after the scheduled time (having had a 6 hour wait at Doha airport and having to take an additional flight to Bangkok and then another to final destination.
Then baggage was delivered a day late.
Have done a bit of reading and it seems that what counts with connecting flights is the total delay at the final destination - or have I misunderstood? The flights were all booked together, not separately.
Any advice gratefully received.0 -

That's not really that late. Qatar airways are well known though for selling through tickets with tight connection times. What was the scheduled connection time just out of interest?
If you read the FAQs and other experiences with the Middle East airlines of delays with connecting flights, you'll get a good idea of what a claim might entail.
If you feel it could take up a lot of your time, consider a nwnf solicitor.Posts are not advice and must not be relied upon.0 -
Hello Richardw,
Many thanks for your reply.
I can well believe that Qatar might be well known for this as there were a LOT of people on different flights at Doha in the same situation (with missed connections) ranting and raving at the time.
One of their desk staff even admitted as much to me, saying that missed connections like this happen all the time and they end up dealing with all the problems. It seems Qatar just don't seem to build enough time into their schedules.
The original connection time was 1 hour 10 mins which I thought was short but thought that it must be possible as otherwise the airline wouldn't sell this option....
I will try and read through the posts you have suggested but am I right that I can put in the standard letter for a claim under the EU Regs because I left from an EU airport, even though this is a non-EU airline and both destinations (Doha and Cambodia) are outside the EU?
Are you saying that most people's experience is having to go as far as Court action with Qatar?
Is there any particular no win no fee solr (maybe online) which specialises in these types of claims?
Thx again.0 -
Most peoples experience for most airlines is having to go to court...If you're new. read The FAQ and Vauban's Guide

So reading the defence from Emirates, they claim that 'FLIGHT' is not defined in the Article 2 of regulation. Therfore they avers that final destination must be deemed the first flight i.e to Dubai.
They also refer that the Folkerts and TUI case the airlines Lufthansa and Air France were community carriers.
They claim as per the Schenckel case that the second flight must be considered as separate unit.
I have the copies of my ticket it was a connecing flight with 1.5 hour transit in Dubai
Emirates also claim that it is time barred.
Please see the DEFENCE below from EMIRATES

Hi, i am hoping that someone may be able to help me or tell me im on a loosing path.
We booked flights from Birmingham Uk to Johannesburg in October 2013 directly with Lufthansa, the flight was going via Frankfurt. We were attending a family wedding on the 6th April 2014.
Flight was departing 3rd April 2014 for my wife and 2 kids.
On Friday 28 March we find out on BBC website that Lufthansa going on strike, we called them and they said all is good, your flights are not affected.
On Monday 31st march we get a SMA message to say our flights are cancelled please call to cancel or rearrange. We called and after after 2 hours waiting were given an alternative date of 5th April. An email followed with new flight details and eticket details.
On Tuesday 1st April my wife went online to check baggage allowances and to see if she could check seating, she was horrified as it showed no flights. After trying to call Lufthansa from 20:30 pm we finally got through at 12:06AM! The customer services agent confirmed that they were not booked on this flight and the next available flight was on the 10th April- After the wedding. Lufthansa had no response to the previous eticket
Due to it being a very special occasion my wife had no option but to cancel the outgoing flight and book a 1 way ticket from BHX to JNB via Emirates costing considerably more on the 2nd April, not to mentions the costs in rebooking car parking and hotels.
We are now back but are now looking at our options to reclaim the cost of booking alternative flights as we are now out of pocket by approx. £1,000.
We have posted an online form with Lufthansa and submitted the eticket which was issued but no response.
Any help appreciated in which way to peruse our claim.

Info please. I booked return flight Newcastle to Brisbane stop 2hrs dubai. With emirates.
On return trip delay over 3hrs leaving Brisbane resulting in missed connection to Newcastle. ÈMIRATES provided hotel meals etc as next flight was following day.Does the compensation rules cover this part of flight? Need to know before spending any more time on this. I checked on a site for historical airline delays and this states no delay on this flight and on time arrival in Dubai. Obviously wrong I spent day in Dubai.0 -

If you were delayed flying from a non-European airport on a non-European carrier then 261/04 compensation does not apply.0 -
Yes to (a), no to (b) - at least under Regulation 261/04. Your travel insurance may cover any losses under delayed luggage.
The FAQs on page will tell you what you need to do next - but you are likely to have to start a small claims action to get your compensation (of €2400).0
