Yes to (a), no to (b) - at least under Regulation 261/04. Your travel insurance may cover any losses under delayed luggage.
The FAQs on page will tell you what you need to do next - but you are likely to have to start a small claims action to get your compensation (of €2400).0 -
After many emails we have now been offered 4 free flights from London to Colombo. As we would prefer not to return to Sri Lanka, in the next couple of years anyway, can we insist on cash compensation ?
If they are offering you the flights in recognition of their responsibilities under the Regulation, you can insist on the cash, yes. If they don't accept liability, but are offering you the flights as a goodwill gesture, you can certainly ask for the cash, but they could say no. In that case, you would need to start a court action.0 -
Last year 21 Feb 2013, i went to Gatwick airport as my wife and two children both under 3 were travelling out of UK using Emirates airline.
Flight was initially scheduled for 1335 but was delayed by 1 hour 10 minutes and scheduled for 1445.
We were informed that we were overweight in luggage although it was a misprint and wrong information on ticket itself.
We agreed and walked away almost in front of their counter and while we were sorting our luggage (i.e taking out some stuff so i can bring it home) believing that we got enough time considering delay.
All of a sudden one of their colleague approached us and informed us that we got only 1 minute left (yes exactly 1 minute that's what he said).:(
We rushed back and were informed that gates have been closed and they can't allow us. A small argument started questioning why they have informed us beforehand of last time when we can come back to check in and also we were right in front of them and they should be more considerate as we got two young babies with us etc.
They called security and airport manager came along who tried to diffuse the situation but airline staff refuse to allow us and he expressed helplessness.
We were made to pay extra 500 quids to reschedule our tickets as according to them we lost our tickets from Gatwick to Dubai and onward. :mad:
Ticket category was BT which according to them means non amendable.
On our return journey, plane was late for 75 minutes from first airport to Dubai and also late for same time from Dubai to Gatwick and i was allowed to board on plane 15 minutes prior to flight.:T.
On return we lodged a complaint on 8th May 2013 which was rejected making false representations even quoting wrong facts.
Our luggage was damage which means we suffered a loss of almost 300 pounds but that claim was rejected as well.

Have you spoken whoever issued your tickets re the baggage allowance issue?
When flights are delayed, the norm is to close the checkin as scheduled. This allows the airlines to finalise their paperwork and potentially get away earlier where possible.
re the damaged baggage, dig you get a PIR report from the airport when you reported it?0 -

i purchased and booked tickets in uk for flight to india.Return flight from india got delayed by over 10hrs-obviuosly this flight does not come under compensation rules, but does the fact that i booked /confirmed tickets in uk make any difference ?0 -
