Car Park Solutions Ltd admits to taking 'No one' to court!

Advice please!! Passing through Dereham for first time in 15 years, received emergency call and stopped at first convenient place. Forecourt of One Stop with designated car park spaces. Stopped to take call - photo evidence shows me facing away from now famous CPS solutions. Due to importance of call and assuming I had done correct thing to park on forecourt of parade of shops I took call then moved on.
So do I pay up quietly or appeal this. As not a local, I would be pleased to get advice as feel this is appalling and not only unethical but feels like entrapment to me as unknowingly caught up in dispute not of my making having read more about this
Thanks0 -

Well, one things for sure, you DO NOT PAY UP! That's the advice all will give you here. You can safely ignore and then ignore everything that CPS might send you. Or you can 'appeal' to CPS if you like(which they will reject) but if you wish to then please start your own thread and you will get the right advice that dovetails your personal circumstances and options and help with how to use POPLA to cost CPS money. But remember, DO NOT PAY Car Park Solutions one single penny!Got a ticket from ParkingEye? Seek advice by clicking here: Private Parking forum on MoneySavingExpert.:j0 -
And STILL I cannot get booked at the same notorious place... it seems everybody but me gets booked there!

Andre Smith is a director of Car park soultions(east Anglia) ltd and operates as Car park solutions limited. He answers the phones for both companies as they operate as one.
The company offered franchises to people and never trained them, let them operate with out contracts on sites. Also never paid the franchisees keeping all the money himself.
Clamping, they would clamp cars and pocket the cash failing to pay the tax.
Smith is a liar, true...
When they use to clamp they would take the car and sell it if the owner did not pay or afford to keeping all the money.0 -

Report your concerns to Citizens Advice regarding your concerns of entrapment. There is ver little signage here and what there is not prominent ,no CCTV signs either.
As there are marked out parking bays outside a shop you may have a good a good case for entrapment.
How long were you parked ,they have to provide a grace period so obtain evidence from the operators CCTV data.0 -
There was no entrapment. S/He parked there of his own free will to receive a telephone call.
However, saying that he should definitely NOT pay these scammers.0 -

Take note - Citizen's Advice are NOT your friends in regard to PPC fake PCNs. Their advice is usually limited to 'pay up'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

How long were you parked there ? how long were you parked before they issued the ticket?the1ofspades wrote: »Hi,
Found this thread, he's my situation.
CPS sent me a lovely letter in the post today, and caught outside the now famous One Stop on Norwich Road, Dereham with their lovely CCTV.
£100, reduced to £60 etc.
People are saying leave it, as its a scam. But noone has mentioned the CCTV 'evidence'. Should I still leave it, or do I need to begin an appeal? Doesn't look like ignorance is an excuse on the POPLA website unfortunately.
Any advice would be great.
Dan
Email the cctv operator to obtain evidence of when you parked and left as they have to give a grace period as a BPA approved operator(see below from BPA code of practice)
13.2 You should allow the driver a reasonable ‘grace period’
in which to decide if they are going to stay or go. If the
driver is on your land without permission you should still
allow them a grace period to read your signs and leave
before you take enforcement action.
Hope this helps0
