Listened again to the end of the interview - last 30 seconds. Andre said the following when pressed about this particular parking area.
"It has to be in the contract that we can take it to court, majority of our contracts it's not in, but this one it is".
The bit to take from this is the bit in bold. So, even Andre is saying that CPS don't have the authority to take motorists to court in the majority of the sites they manage.
Another good reference link for future CPS threads?

Even if its in the contract about taking someone to court it wouldn't matter as they wouldn't have any rights in the land

When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Think they need to change this bit ASAP!
Our new customer portal will allow "uers" of our "carparks" who have "recieved" a Parking Charge Notice to "lgin" and Pay their "fine" online Customers will also be able to view additional information regarding their PCN. This New service is currently in development.

Getting back to the court cases, it is poor business for these companies to take cases to court, at best they have a 50/50 chance of winning. Then they may never get paid.
Most county court cases for debts are clear cut with contracts and credit agreements to back them up, so its basically a rubber stamping process.
The cost and the chances of losing make it a no no really except for the publicity factor its stupid!0 -

Norfolk Parking Enforcement (NPE), based in Norwich, previously monitored the parking bays outside One Stop and Sunflower House for six months.
Anyone who parked outside the shops without the landowner’s permission risked a fine of £100.
But Jonathan Lecaille, managing director of NPE, pulled out of the deal with Mr Shainfeld a fornight ago because he felt the enforcement was “unethical”.
