Fair enough...I do get aerated about this whole scam and astonished when people pay. Sorry to anyone offended when I called payers of fake PCNs 'stupid'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

CM, isnt this just a little diofferent from the normal scams? ie a landowner who, for whatever reason, wishes the public not to park on his land and has engaged a PPC to implement that policy. This seems a different case than those normally posted, where an unsuspecting customer is scammed by a PPC in most cases against the fundamental interests of the retail store or landowner?
Probably I'm missing something......0 -

The landowner does have the right to manage a car park on their land. However, they should not do so with the use of a PPC. The PPC does not really manage a car park but levy what amounts to penalty to the driver of a parked car if said driver 'break' their 't&cs'. Its a scam. Of course, if the landowner does not want cars on his land then some form of physical barrier is all that is needed.Got a ticket from ParkingEye? This!
And a PPC cannot make a contract with a driver nor allege any loss for trespass because said PPC doesn't have right of of occupation or possessory title in the land.
The landowner would have to draw up some sort of lease or Deed of Assignment I think, to the PPC, and no-one with any sense is going to do that!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well it looks like the solicitors have looked into it and seen the error of their way. They have now removed all the erroneous advice from their site and the EDP have pulled the story with said advice. Hopefully they will now be able to furnish their clients with the correct information.
Well done Basfordlad, a few more enlightened people :T'We can get over being poor, but it takes longer to get over being ignorant'

I don't think it is possible in this case as it looks like the parking area is shared with an undertaker who has paid the landowner for parking rights.
Seems that if you want to go shopping in the store, to avoid a ticket you need to take a dead relative in the passenger seat.0 -
Hi,
Found this thread, he's my situation.
CPS sent me a lovely letter in the post today, and caught outside the now famous One Stop on Norwich Road, Dereham with their lovely CCTV.
£100, reduced to £60 etc.
People are saying leave it, as its a scam. But noone has mentioned the CCTV 'evidence'. Should I still leave it, or do I need to begin an appeal? Doesn't look like ignorance is an excuse on the POPLA website unfortunately.
Any advice would be great.

This is not a criminal court , CCTV evidence has no bearing at all. So ignore! If you require further help please create your own thread below instead of using this one- thanks
