    they failed to rebook one passenger on a flight and had to rebook with BA at more expense.

    And the time lost

    Try as I might, the various pieces of information seem to be confusing and unclear.

    It sounds like you would have a fight on your hands here. No compensation is due from the airline when the delay is caused by ATC strike so nothing from the airline for the 3 that were put on the later flight apart from reimbursement of refreshments if these were not provided. You could check your travel insurance and see what it may cover but normally that is only after 12 hours

    For the 4th person, if they are any time accepted that their ticket would be refunded and cancelled then there would not be a claim. You would be looking to prove that the airline refused to reroute and a refund was never accepted, then there may be a chance of getting the difference back between the old and new ticket.
    If the 4th person agreed to a refund then the only option would be to see what the travel insurance offers

    I'm sitting in Malaga and looks like my wife and I are in for an Easy jet flight delay back to Glasgow this afternoon. At the minute they're saying 2.5 hours delay but l guess it could end up past the 3 hour mark.

    Any tips on what I should look for in the way of proof of explanation from easyjet should we go over the 3 hour time frame.

    Bear in mind that the handling agents at Malaga may not know the exact reason and will just give an excuse. The crew may know better

    Right to care - meals/refreshments in reasonable relation to waiting time, two free calls or emails.
    Delay - Written explanation of 261/2004 and reason for your delay. Remember 3 hours delay relates only to arrival time at Glasgow and not departure from Malaga.

    Is this flight number U26862? If so, i'll try and get some info on where your plane is.
