Flight delay and cancellation compensation, Easyjet ONLY

  • Hi there, just wondered if someone could give me a bit of advice regarding a flight cancellation back in December 2010 from Copenhagen to Stansted. We were due to depart at 9.45pm on 20 December and about an hour or so before we were due to take off we were told the flight had been cancelled (not by Easyjet staff but by our parents back in the UK!!). Easyjet did put us up in a hotel for the night but we had to book our own return flight with another carrier for the next day as Easyjet could only offer us a flight 3 days later (with Christmas a couple of days later and children in tow this was not an option). We received an email from Easyjet the next day informing us our flight had been cancelled (as if we didn’t know!) and they said it had been cancelled due to the knock on effect of the bad weather. When we returned home we contacted Easyjet requesting compensation for the cancelled flight. We were told it had been cancelled due to “extraordinary circumstances” (the bad weather) and they did not have to pay the compensation. We then wrote to the CAA in Denmark and after months of waiting we got a reply. They agreed that the weather had been bad in “previous sectors” operated by the flight and that compensation was not applicable.

    Obviously this all took place a couple of years ago but we have decided to revisit it. My question is does knock on effect weather count as “extraordinary circumstances”? Flights were able to take off and land at both Copenhagen and Stansted that day so it was not a problem with our starting point or our destination. Also, as we have had a reply from the CAA in Denmark basically agreeing with Easyjet, is this a claim worth pursuing or would we be wasting our time?

    If you read the Regulation (261/2004) and/or do the appropriate search on the forum, you will get a good steer as to whether or not you have a claim.

    Alternatively, have a word with a no win no fee lawyer and get their view.

    Hi there - just been revisiting an easy jet flight we were on in December, 2010 from Berlin to Liverpool. The delay was borderline 3 hours - I looked at flightstats this morning (see link) and it indicates that the 'estimated gate arrival time' was changed to 12.10am - which would make the delay 2 hours 55 mins. However, it is unclear what the ACTUAL gate arrival time was....I am unsure how to check this. It seems worth digging a bit more given the delay is so close to 3 hours. Any ideas as to whether/how I should proceed? -all help appreciated!

  • My flight from Palma de Mallorca on March 16th. 2013 was delayed for over 3 hours. The email I received on my return home from Easyjet stated this was due to a technical fault. However, the true cause of the fault was in fact a tanker had been driven underneath the plane at Manchester Airport as it was preparing to fly out to Palma. Easyjet then had to wait for another plane to be flown to Manchester from Liverpool, before it could then bring out passengers from Manchester to Palma. My question is :- I am entitled to claim for flight delay compensation?

    Yes but only if you post any more questions on the correct thread after you have read through it and in particular the FAQ's on page one.

    Yes you are - submit a claim to EJ and wait a couple of weeks. If no reply send them a reminder indicating if you do not hear anything within say next 14 days you will take court action (letter known as LBA/NBA)..... proceed from there in accordance with FAQ's. Sounds like you have a good chance.

  • I was delayed Gibraltar for around 10 hours due to weather conditions in the uk. The flight did depart from Gatwick at around 6pm and got diverted to Malaga due to the wind in Gib and we all got transferred to Malaga, but half way there we all got a text From Easyjet saying that the flight was cancelled (this was Christmas eve) due to Staff going over their hours. I contacted easyet and they have told us that we are not going to be compensated as it was due to the weather but I was due to staffing hours. Finally after 31 hours we got to the UK.
    Contacted CAA but they said they cant help. Can anyone give me any advice please?

    I am sorry to hear about your flight delay dated 16th. March 2013.
    The aircraft was suppose to depart on time, however last minute the aircraft sustained significant damage due to water servicing truck turnaround at Manchester and removed from service and this was to ensure the safety of passengers due to which we had to arrange replacement plane.
    We try our best to minimise delays but there are circumstances which are beyond our control. This technical reason is considered as extra ordinary circumstances.
    Therefore we are unable to offer you any compensation.




    Having now read the National Enforcement Bodies list, this type of incident is listed at number 19.
    It is now my understanding that I would not be able to make a successful appeal against Easyjets decision.


    Easyjet ground staff at Palma told passengers of the technical delay, how ever, the cabin crew were more open re the long delay, informing passengers that a replacement plane had to be flown from Liverpool to Manchester, by which time the original crew were out of their hours, and then a standby crew had to be found.
    I was just thankful to be back in the U.K. safely.
