I explained to them in the original email that we were unable to take the flights for the above reason and they sent me an email back saying that I was entitled to compensation please sign this form, I signed the form then got another email back saying sorry as you didn't take the flight you are not entitled to compensation.
I read on the money saving expert website that:
What if my flight is delayed by five or more hours?
When the delay hits five hours, as well as costs for food, accommodation and other extras, you qualify for a refund of the ticket cost, no matter whose fault the problem was, if you decide not to travel. To also get compensation, the problem must be the airline's fault.
So these state that I am entitled to compensation - what is correct??
IMO a refund for the outbound leg only... with meal vouchers from 2 hours delay up to the point of cancelling.
You didn't travel so no compensation.
The return leg 'ought' to be refunded as part of customer service but it's not under the EU261 reg, as you didn't check in at the return destination airport.
I know you *couldn't* because of the earlier delay, but it's catch 22.0 -
The Mondaysavingexpert website says that if it is delayed by more than 5 hours if I decide not to fly I am entitled to compensation if it is the airlines fault0

Well I'm not going to examine it myself, but I suggest you read it again, because if it says that then it is wrong.
Also read the EU261/2004 Regulation which is linked in the FAQ's. That's the law, not the MSE website.0 -
Sorry if this has been answered before, I have only just stumbled across the changes to delay compensation.
I am thinking of claiming for an Easyjet flight in 2009 delayed over 3 hours and over 1500 miles.
Problem is I have no emails/boarding passes etc, I have worked out the flight number and confirmed the delay, is this, along with our personal details likely to be enough?
Thanks for any advice.

Hi
Could someone please clarify, we were booked on a flight Gatwick to Bordeaux that was eventually cancelled (no reason given) following ever increasing delays. We were permitted to rebook on the equivalent flight the following day. There were no fees to pay for this.
As we accepted the flight the next day can we make a claim? (I am assuming not)
If we can claim, I have not been able to find a documented reason for the cancellation where can I find this?

EJ will give you the reason if they deny your claim. So instigate the claim first. (as detailed in the FAQ's)0 -
I've had a reply from the CAA. They believe my flight DOES fall within the scope of EC261/2005 and the recent case law.
It's now back with EasyJet for reassessment. Presumably if they still reject, I now have a strong case for a small claim with the opinion of the CAA behind me?0 -
