Hello, I would really appreciate some help om my case.
Flight was delayed around 4 hours departing from Geneva. At original departure time, we were sent off with the bus to the plane, but after waiting for 15min, we were sent back to the gate and received the information that the crew was not on the plane, and we could therefore not board it. It turns out they need to call in standby crew, which all in all took 4 hours before we could board the plane and leave
I sent in a compensation claim to EJ, and now I have received a rejection email, claiming the following:
"(...) industrial action by French air traffic controllers had caused extensive disruption for all airlines across Europe. Flights had to be re-routed to avoid the region over Marseille and air traffic control across other areas, substantially regulated air space. This situation caused long delays to flights as aircraft waited for permission to operate. Knock on delays continued to build up during the day, as in the case of your flight. We do take reasonable measures to avoid delays and cancellations to our flights by having replacement crews and spare aircraft available in our network. In the circumstances, however, higher than expected levels of disruption meant our replacement crews and spare aircraft had already been deployed. "
For me this does not make any sense. The plane was waiting to fly off and we were almost boarding it. Isn't this at EJ's fault, for not figuring out their own crew capacity?
Furthermore:
'"(..)Our assessment team have thoroughly investigated all the available information and our decision is final. "
Is the next step to send out an NBA?
Edit: I also checked my claim on EUclaim, and they informed me that they could not help me with my case, which makes me question it a bit.

Does that make it a lost cause? I feel that their explanation doesn't add up with that the airline should have done all in their power to avoid the delay. Plane was also heading to copenhagen, and no direct contact with the Marseille problem.0 -

The possible issue with making a claim is there was a Marseille ATC strike that weekend which could have put your plane out of position.
Botts can't help as the flight neither started or finished in the UK. You will also need to find out which easyJet company operated the flight.If you're new. read The FAQ and Vauban's Guide

- boarded plane, then told further delay due to thunderstorms
-finally got given a slot to fly but by this time the crew were out of flying hours so flight cancelled and we had to stay the night and fly the next day (12 hours later)
Would I be eligible for compensation under the EU rulings? I know you can’t claim because of weather(which is what started the problem) but wondering if I am eligible as the secondary problem was EasyJet crew out of flying hours?0 -

Quick answer, no. Crewing problems are inherent in the operation of an airline. There are some CC judgements to this effect.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0
