So after chasing this up on Facebook I finally got a response on day 45. They're claiming it was due to the weather.
Absolute nonsense. I even have the screenshot from their very own app saying why it was delayed.
'We're sorry for the delay of your flight. This is because we had to make some changes to our flying program and changed your plane on an earlier flight. This meant that the flight was delayed departing.'
'We are sorry for the continued delay of your flight. Due to the late arrival of the plane into Stansted last night, your plane was late to have its mandatory checks overnight. This then had a knock on effect on todays operation and this has meant we had to delay your departure time.'
Fuming. What's my next play? NBA straight in?0 -
Just got a reply to my screenshot saying yes but the aircraft was late arriving for the previous flight due to the weather and is being listed as the primary cause of disruption.
Might just pass this on to Botts tbh, not doing my anxiety/stress levels any good.0 -
Someone may be able to do some investigatory work on FR24 or similar to see what happened to the previous flight/sector.
Convenient that the reason was changed in their favour?

Is this still a valid case/legal arguement or has it been overruled? The date of the article is September 2013.

Very convenient. Every single claim checker says we're due, surely it's a bull***t reason? Worth sending the NBA in and testing their resolve? Not sure I could go to court myself, suffer from bad anxiety so wouldn't be good for me. If I don't get anywhere I might have to give it to Botts.0 -
Yes, flight number and date and I can have a look. It’s possible then to use the aircraft reg to check the preceding flights it operated.
Also, weather at airports can be checked too.
Weather would only be extraordinary if conditions were, indeed, ‘out of the ordinary’.0 -

Thank you! My flight number was EZY3155, Stansted to Dalaman on 1st June. Was supposed to depart 15:55.
I see through Vauban's Guide that they often claim extraordinary circumstances so should have expected it really.
Botts, EUClaim, any other I could find on google all say compensation due.

I've emailed the communications team at Bott to see whether the ruling is still in effect. If it is, Easyjet are up s**t creek here. Thanks for finding that!0

I did vaguley recall this decision, although as you can see it was along time ago, even pre Huzar!
Except that this is a CC judgement, so although a strong arguement, is not binding on other CC judges.
Unfortunately, EU Claim and Botts tend to be optimistic on potentially valid claims, sometimes coming back with a no-go scenario.

It was scheduled to arrive at 21.55 local time. It actually landed at 02.03 local time. You departed UK at 20.02 BST.
The aircraft that flew you out was operating its 5th flight of the day. It had already flown STN to Ibiza and back, STN to Amsterdam and back. Every single previous flight was delayed.
I can’t see weather being a factor here - it simply looks like knock-on. The previous flight it operated didn’t leave AMS until 5.40PM BST and landed at STN at 6.26PM BST. Your flight departed at 8.02PM BST. The aircraft was playing catch up all day. It departed its first flight of the day (to Ibiza) almost three hours behind schedule! And that was knocked on from delays on 31 May.0
