    I was informed by text message about twelve hours before the (early morning) flight was due to leave. Unfortunately I've changed mobiles since so don't have the actual wording but the gist of it was, "we've cancelled the flight due to industrial action but will give you a seat on our next flight or give you a refund".

    Of course EJ may have had no option but to cancel. If ATC told them that the flight slots are cancelled, as they did in my case, the airline has no option.

    My cancellation was identical circumstances and I preferred knowing in advance so I could make alternative arrangements, at easyJet's expense. So am I entitled to compensation. I would say not. easyJet denied the claim VERY quickly. I haven't actually put details through Botts as I consider my interpretation of the regulations to be correct.

    I suspect that there is a hierarchical structure to ATC where budget airlines such as eJ and RA get cancelled first where's as blue chip/national airlines get a degree of priority. BA AF KLM etc all still had flights to Marseille, where the ATC strike was planned. But didn't actually happen. Or maybe these airlines sat on the fence, preferring to deal with the problem at the time?

    On the flight eJ have agreed to pay me compensation for I got an email asking for bank details for a direct transfer (which hasn't materialised after more than a week) but that's just my one-off experience.

    So you have received compensation for the ATC cancelled flight where the ATC strike didn't eventually happen?

    I would concede and agree to this, the question must be who decided to cancel the flight EJ or ATC?

    I suspect EJ on the advice of ATC and not an instruction. I do agree that it’s favourable for the airline to make an early decision, but if they do so they are IMHO liable to make payments in line with EC261 if the envisaged genuine EC disruption does not occur.

    I’m deliberately ignoring the last few posts, because I‘ve not got a clue who’s been paid for what! Lol

    I’ll revist in the morning, I’m sure it will be as clear as mud by then.

    This is what the regs say should happen, and from what you say it sounds like you were given misleading information about the options open to you. i.e two options and not three.

    It also sound like you may have already been offered EU261 compensation for this delay (post3128), is that right?


    Right to reimbursement, re-routing or rebooking in the event of denied boarding or cancellation
    Article 8(1) of the Regulation imposes on air carriers the obligation to offer passengers a triple choice, between (i) reimbursement of the ticket price36 and, in the case of connections, a return flight to the airport of departure at the earliest opportunity, (ii) re-routing to their final destination either at the earliest opportunity or, (iii) re-routing at a later date at the passenger!!!8217;s convenience under comparable transport conditions, subject to availability of seats.

    In addition, whenever an air carrier gives partial, misleading or wrong information to passengers on their rights, either individually or on a general basis through media advertisements or publications on its website, this should be considered as an infringement of the Regulation in accordance with Article 15(2) read in conjunction with Recital 20 and may also constitute an unfair or misleading commercial business-to-consumer practice under Directive 2005/29/EC of the European Parliament and of the Council32.

  • Hi.
    In May, my flight from Crete was delayed by 4.5 hours. At the airport, after I enquired, I was given a prepaid card to the value of 4 euro for food and drink.
    There was only one food outlet open - the cheapest thing (chips) alone was 4 Euro, so I don’t feel the amount given was adequate for food and drink.
    I have asked Easyjet for compensation for the delay, but they replied to say the delay was due to a French air traffic control strike. There was a French air traffic control strike on that week.
    However, the planes to and from France didn’t suffer any delay. The truth is that the plane that was scheduled, hadn’t departed the UK by the time it was supposed to have left Heraklion. So our departure was delayed because we were waiting for that plane to arrive.
    Where do I go with my search for compensation? Any advice would be gratefully received.

    Botts and EU Claim say I have a claim with my flight being cancelled 24 hours before, due to an ATC, that didn't happen.
    What are peoples' opinions on this scenario? Is this a valid claim?


    EJ have already rejected my claim ( I submitted in error thinking it would also allow me to submit expenses claim) ;)
