    We were due to fly from Hurghada to Gatwick on 4th July at 7pm. The incoming plane from Gatwick was 1 hour late but eventually we got on board, he cockpit door was open and lots of ground crew were around and chatting to the pilot and cabin crew. Some cases were also off loaded

    Some of the passengers were asked if they wanted to fly on a different date & were offered ( I think ) 600 euro.

    After being on the plane for approx 1 1/2 hours the pilot said we all had to get off as the crew had gone over their hours. They told us they had tried to get us to Milan but couldn't.


    We were bussed to a couple of hotels and spent the night there. We eventually got on the plane which went out at 12pm the following day. ( 18 hours delay )


    Easy jet have turned down my claim saying it was ' extraordinary circumstances ' due to bad weather & congested skies.

    I've read the book and it's very good

    What are my chances on getting compensation

    Put your flight details into bottonline and euclaim they will tell you if they think you are due compensation, then get back

    We were booked to fly to Gatwick on the 9pm flight from the Isle of Man. The incoming flight struck a bird so our flight was delayed...until the following morning, we had to spend the night on the airport benches!
    As advised at the time we put in a compensation claim. After chasing this I got this response;
    Decision summary: We!!!8217;re sorry that your flight to London Gatwick was delayed overnight. Our assessment and legal team has carefully reviewed your claim and the circumstances around your flight and have confirmed that your compensation claim is not eligible for compensation payment under EU Regulation EU261/2004. Please note that this may not match with the information you were given on the day of travel, as our staff in airports, and on-board, may not have had all the information concerning your delayed flight.

    We!!!8217;re sorry that your flight was overnight delay.     Our assessment of your claim
    To further explain what happened on the day; on descent into the Isle of Man, the aircraft scheduled to operate your flight, incurred a bird strike. When this type of incident occurs, a full inspection by qualified engineers is required. The aircraft was subsequently declared unserviceable. We had no alternative but to delay your flight overnight. We do take reasonable measures to avoid delays and cancellations to our flights, by having replacement crews and spare aircraft available in our network. However, on this day, higher than expected levels of disruption meant that our replacement crews and spare aircraft had already been deployed by the time of your flight.

    Do you think I have any further chance of compensation?

    It's unlikely. The ECJ has recently ruled that bird strikes constitute extraordinary circumstances.

    Depending on which rotation said bird strike occurred. Anything earlier than your flight or the previous one, I would say a claim is possible.


    A HUGE concern to me is that you were left to sleep on the airport benches.
    Airline are required, by the regulation, to find you accommodation and pay for it.
    Send a complaint to the CAA as easyJet have broken the law.

    It was the plane we were due to get on the struck the bird.
    To be fair that weekend it was the IOM TT so there were genuinely no hotel rooms available. At first the airport staff told us we would have to leave the airport as it was closing!!!!! Eventually someone came along who had the authority to keep it open!
    Is this still worth further complaint

    If EJ didn't make any attempt to find you accomadation then yes. It won't get you anywhere personally but the general public will need to make the CAA aware of the airlines deliberately and repeatedly breaking the law.

    Opinion of whether I should take this refused claim further would be appreciated. I was due to fly to Zakynthos a while back from Bristol when there was a threat by Greek ATC of a four hour stoppage the following morning when we were due to arrive so I got a text the previous evening telling me the flight was cancelled and I could either go on their next flight which as there's only one a week on the route would've chopped my holiday in half or get a refund.

    Obviously I chose a refund and managed to get a flight from Gatwick (a much longer drive) for four days later.

    It then transpired that the threatened ATC walkout didn't happen and many other flights with other airlines flew in without trouble.

    They have refused my claim due to industrial action and I replied with the following email (to which I've had no response)...

    "Concerning your decision to refuse my claim for compensation in the above case under article 7 of EU261/2004 rules due to the cancellation being due to industrial action I would dispute that. The industrial action was a threatened four hour stoppage by ATC in Zakynthos which in fact never happened; other airlines weren't so quick to cancel and their flights went ahead as planned without any problem.

    You offered me seats on the next available flight which, as you only have one flight a week Bristol/Zakynthos would plainly have been useless as my accommodation/car parking/car rental was already booked and paid for. As if was I had to re-book from Gatwick and go to all the extra expense that entailed and still lost four days of hard worked for holiday.

    I think you were too hasty to cancel the flight causing me and all your other passengers huge unnecessary inconvenience. In the light of this I'd like you to reconsider your decision.
