Flight delay and cancellation compensation, Easyjet ONLY

So you have received compensation for the ATC cancelled flight where the ATC strike didn't eventually happen?
No, I've had a claim accepted for a different flight (from Murcia) that was delayed by a fault developed when it was landing, sorry if I' didn't make that clear.“Procrastination is my middle name....well it would be if I could be ar**d to contact Deed Poll."0 -
It was scheduled to arrive at 21.55 local time. It actually landed at 02.03 local time. You departed UK at 20.02 BST.
The aircraft that flew you out was operating its 5th flight of the day. It had already flown STN to Ibiza and back, STN to Amsterdam and back. Every single previous flight was delayed.
I can’t see weather being a factor here - it simply looks like knock-on. The previous flight it operated didn’t leave AMS until 5.40PM BST and landed at STN at 6.26PM BST. Your flight departed at 8.02PM BST. The aircraft was playing catch up all day. It departed its first flight of the day (to Ibiza) almost three hours behind schedule! And that was knocked on from delays on 31 May.
Thanks for that, PomBear. I was sat at the gate watching the plane flying from Amsterdam on the App when Easyjet were claiming we were boarding in 15 minutes. Comical.
Wondering how I proceed now. The weather reason is clearly absolute nonsense.0 -
I would issue an NBA - they don’t have a valid defence so may well cough up when they realise you aren’t going to fall for their nonsense.0

Botts and EU Claim say I have a claim with my flight being cancelled 24 hours before, due to an ATC, that didn't happen.
What are peoples' opinions on this scenario? Is this a valid claim?
EJ have already rejected my claim ( I submitted in error thinking it would also allow me to submit expenses claim)
NBA time or hand over to Botts? If you're new. read The FAQ and Vauban's Guide

Any responses on this one?
Well I think I’ve made my views clear, an anticipated EC that doesn’t actually happen is not an EC. So you have a valid claim IMHO.
Only you can choose to DIY or use Botts, I’ve got an update to post about my J2 Paris delays and I’ll update the ‘has anyone used Bott & Co’ thread.
I offered to hold PomBears hand in court, I’ll extend the same offer if you DIY lolAfter reading PtL Vaubans Guide , please don't desert us, hang around and help others!

Thanks for your encouragement Novice.
What I am struggling with is the actual legal argument or reasoning a case like this would use?
I suppose there is always the second test or hurdle in a compensation claim - the aspect of lack of effort to mitigate the delay on 2 fronts:
1: The strike didn't happen and easyJet knew 24 hours before hand that the strike was off and could have actually flown.
2. The alternative flight was 1 week later. If you're new. read The FAQ and Vauban's Guide

disgraceful behaviour by EJ given the alternative was one week away!
Give me half an hour and I'll update the J2 thread with my yesterdays news, didn't want to post it till the £££ is in the bank but it might help a little. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I think we should bow to Botts greater knowledge on this one.
I know that when LHR ATC require airlines to reduce flights by say 20% due to anticipated bad weather, usually a named storm, and often the following day, it is accepted by the CAA as an EC.
I also know that on one occasion they cancelled flights and then the anticipated bad weather did not arrive. However, I did not see the result of any cases brought after this (none) event that questioned this accepted wisdom.
My feeling is that if it did not happen (anticipated bad weather or ATC strike) it cannot be an EC. After all, this is a massive inconvenience to passengers and thats what the regs are there to protect against. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

My Easyjet flight for a 8 day holiday was cancelled at the exact time I was to board. I managed to book a flight for 2 days later. The earliest available with Easyjet I put in a claim for 2 days lost accom via their flight compensation site. I had this reply. The claim you made for Hotel is a private arrangement which was booked before/after the flight disruption took place. Though we understand that you have incurred expenses, however under the guidelines of EC261/2004, we do not cover any pre and post flight arrangements. As it was Easyjet’s flight cancel that made me lose 2 days aren’t they responsible. Thanks for any replies.0
