  • Hello
A question about a delay and then a flight cancellation. Is it possible to get compensation for delay if the flight is then cancelled? My 14.20 pm flights to Barcelona on Monday were delayed and we were eventually told it had been cancelled at 20.00. It then took us about an hour and a half to get out of the airport. It was an absolute shambles with no information given to us. Easyjet have emailed me to apologise for the cancelled flight but confirmed :
“On Monday we had hoped to operate your flight but due to both runways at London Gatwick being closed we were unable to. This was the result of; firstly an Air Canada Rouge flight having technical issues when it landed, and then the second runway suffering damage and requiring maintenance. This meant that no flights could depart and land for some time at the airport. Many of our flights to London Gatwick were diverted and others across the network cancelled.
As the closure was outside of our control you will not be entitled to compensation”

I have had a quick look at the guide referred to on this forum but am still unsure what happens if there is a long delay before a cancellation. Easyjet are going to refund our flights but what about the days leave I lost and the fact that we were in the airport with our children for 10 hours. I would not normally bother complaining but it was an awful experience with no updates from Easyjet.

Firstly the original EU261/2004 law refers to cancellations rather than delays. A later case ruled that delays in excess of certain times for certain distances should be treated the same as cancellations, so in answer to your first question - 'depending on circumstances', YES, you can claim for a delay that is later cancelled.

With regard to these particular circumstances, having checked reports it appears that the Air Canada Rouge flight actually suffered a burst tyre on take-off from the Main Runway meaning routine inspections had to be carried out to clear debris & check for damage. The flight circled for an hour dumping fuel & then returned to Gatwick under 'Emergency Landing' protocol & landed on the back-up runway causing damage that had to be repaired & closing it for several hours.

I doubt if any delays relating to this incident are subject to compensation other than the Air Canada Rouge flight & subsequent knock-on's from that on their own flights - they may be liable if their tyre maintenance wasn't up to scratch (which is unlikely as the tyres are a pretty important bit of safety equipment).

The incident was outside of the control of all other airlines & with such long delays they have all suffered as a result.

I've not come across delays due to a tyre blow-out before - interesting case & hopefully others can also advise.

Flight delays - Vauban's Guide has been of immense help - please read it before posting questions - I'll be surprised if your answers aren't in there.
April 2016 - successfully claimed €1600 from Thomas Cook for 6 hour delay in August 2015
Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.

See Jet2 Tenerife South, where a jet2 had 3 tyres blow on landing, completly trashed the wheels.

I had the standard response from Easyjet advising me of my right to forward to CEDR, to which I replied saying I disagreed. Main points were-

    1. Captain and Ground Staffs own statements at the time
    2. 'Adverse Weather' was directly contradictory to their own press statement
    3. 'Adverse Weather' directly contradictory to their own app about reasons for delay.
    4. None of the checkers report any adverse weather for this flight.

I also sent an email to the MEN and copied in Easyjet Press office to say that EJ were now saying that this hadn't happened at all.

To my surprise I woke up to an email from EJ saying that the email declining the claim was a system generated one sent in error (which is in itself a lie) and that I was due it, and that it would be paid into my account within 7-10 days.

Will see if it is actually paid.

Im in a very similar situation, easyjet trying to give me the ole 'Weather' when Ground staff announced that the actual reason was cabin crew fatigue. Can you provide me with any guidance please? What is M.E.N. and where can I get evidence that a specific flight im looking for touched down?

    Many thanks
    Tb

Was yours the same flight? put your flight details into EuClaim and bottonline flight checkers to see if they think you have a claim then come back

Thanks Justice, It was actually a flight 16/07/2017 easyJet 137 MAN to BFS Jul 16, 7:55 PM. Delayed till 23:30, 22:25 ground staff announced in Manchester T1 that flight was an hour away, and at 22:35 ground staff announced flight was cancelled due to cabin crew fatigue. Now easyjet are claiming weather albeit our plane (from hamburg) the flight landed at 23:30, and also flights from Geneva and Amsterdam successfully landed around the same time, the sky's where clear. Easyjet are trying to use weather as a technicality as the plane much earlier in the day was heading to some other country, and ended up landing in Malta earlier that day.

Ive logged a claim via your suggestion bottonline, and is all green (so far)! Thanks again
  • Hi Gorie
My wife and I were also booked for the the same flight EZY8340 TLS->GTW on 9 July..
Our claims for accommodation/food/taxi have been refused because "we didint use their portal", ... when in reality, we followed the instructions from the EJ customer service representative!!
Our claim for 250 Eu has just been declined claiming "natural disasters".
Obviously we wont accept the EJ decision.
I'm happy to share details with you directly.
    /Tim

Hi there, I had a cancelled flight in Geneva on Monday night travelling to Gatwick due to a Air Canada plane. As it's not Easyet's fault they are stating I am not entitled to the €250 per head comepensation, but surely someone is responsible to comepensate me? Not sure I understand the new rules.
Easyjet have said they will reimburse my travel fees and refreshment costs. Who do I claim from for food, drink, extra parking at Gatwick etc? I would have thought the compensation would have covered it. Do I just have to claim off my travel insurance? I'm in muddy waters!

Thanks in advance for any advice.
