    If you bought refreshments you could claim reimbursement with receipts under duty of care

    Hopefully this information may help. I was on the 1810 from Berlin to Gatwick that day (i.e. the flight before yours). It was delayed and eventually left at 2125, however made up some time and arrived just under the 3 hour compensation threshold :(

    You have my sympathies for this delay. However the pertinent information is that our delay was caused by the need to bring a standby pilot in from Paris. There was no mention to us of air traffic control issues. Crucially a flight did fly from Berlin to Gatwick only 10 minutes previous to when yours should have (despite the initial delay).

    I don't know what the next step for you would be but I hope this information might be of some help to you in showing up easyJest's lies (that's a genuine typo but it feels somewhat appropriate).

  • Hi All,

    I've been given compensation for cancelled/delayed flights in the past and am stumped by this one...
    - Flight from Stuttgart > Gatwick (EU)
    - Cancelled at 11th hr due to late arriving aircraft (tech fault on another journey)
    - Offered no accomodation as local hotels were booked up
    - Stayed with friends and booked on a BA flight for the following morning
    - Easyjet offered us a new flight at 2pm following day but was way too late for us so we asked for refund of originial cancelled flight and to be removed from this new flight (we'd have lost another day)
    - I am now seeking the 250€ compensation as the cancelled flight was their fault and we'd only have been able to land at destination about 15hrs later if took their new flight.

    - After a couple of emails, Easyjet are refusing to honour the compensation as we didn't take their second flight, apparently we'd have to have flown with them again to get the compensation?? It was far too late for us, 2pm the following day! Sounds like madness to me and this policy should be trumped by the EU/Civil aviation policy.

    Any help most welcome!

    IMHO, you are due compensation. Others have a difference of opinion on this.
    Your flight was cancelled, and not due to an EC. They didn't have the plane in the right place at the right time.
    They didn't fulfill their duty of care in finding you accommodation.
    Did they offer you the new flight at the time of cancellation or a later time? (not that it really makes much difference).
    You will probably have to start taking this through the legal process.

    After the flight was cancelled we got an update on the app saying we were on a new flight (the next day). It was probably about 1hr later.

    How would you recommend i pursue this via the legal route? I see lots of companies who take on the battle for a fee. I'd love to take this on with no additional cost - it's clear cut in my eyes.

  • On Thursday 22nd June our 2155 flight from Rome to London Gatwick was first delayed by 2 hours. Then at 2140 (Italy time) I got a text saying our flight had been cancelled. We were then told to go to the Easyjet desk at the airport and sort out new flights. After waiting an hour we were told they couldn't fly us back to Gatwick until Tuesday 27th June! The only other option was a flight to Luton at 2150 on Sunday 25th June. These were not an options for us as we both had commitments on Friday 23rd June and Saturday 24th June that we needed to be back for and we had to be back in work on Monday 26th June. We also had our car parked at Gatwick airport on a ticket until Fri 23rd June at 2125 which we somehow needed to collect as well. We were told at the desk that we would get compensation for 250 euros a person and were free to go and book new flights as they couldn't reroute us within 48 hours. We ended up booking a flight to London City Airport at 450 euros a person with AiItalia. This was the only flight we could take that would get us back to London in time to make our commitments so we had to take them.
    It then took Easyjet until 2am to get us a hotel room as they wouldn't let us find our own rooms. The hotel then turned out to be a 30min drive away from the airport and we were made to pay for our own taxi there and back at 60 euros each way.
    Our new flight was for 9am on Friday 23rd June so we were back in a cab at 6am having only had 2 hours sleep. Both at the airport and hotel we were given no food or drink. They gave us a card for 4.50 euros but there was only one bar left open in the whole airport and everything was so expensive that it was a choice of either a drink or food.
    Once we were home I then had to pay to make my way back to Gatwick to collect my car at £50 for a taxi. The whole thing was a nightmare and now to add to the misery I have had an email from Easyjet saying that we are in fact NOT entitled to any compensation despite being told we would be at the Easyjet check in desk. Surely they can't do this?! They will be putting us in to massive debt if they don't at least pay out for one of the flights we took home. They treated us so badly throughout the whole experience I can't believe they won't pay out! :mad:
