Hi,
I am just one of the posters on here who is waiting for Easyjets response but I would also like to say thank you to Centipede (I have already personally said thank you to Mark2spark). It is commendable that you give so much of your time to posters on here and I for one really appreciate it. Sally0 -
I'm not trying to be greedy, but my travel group was just offered compensation this morning for a 12 hour delayed flight in 2011, but Easyjet declined to pay for the infant that was travelling. The infant payed a 'charge per infant (under 2 years)' but Easyjet said in their compensation offer:
'Please note that infants are not entitled for any compensation unless they have booked a separate seat for them. This is inline to European law and our Carrier's regulation which you've accepted at the time of booking'
I was under the impression that as long as you 'paid something for the infant traveling' that they were also entitled to compensation as they had to wait for 12 hours too, like everyone else? Can anyone offer some advice, or point me to a similar question on MSE that might offer me some help? Thanks so much for the help, as I'm just trying to figure out if Easyjet is following the law or if they are trying to save 400 euros for the infant? :A0 -
If the infant is named on the flight passenger list, then they are a passenger.
The regulation just refers to 'passengers'. A debate about how much an infant is charged is a red herring.Posts are not advice and must not be relied upon.0 -
Hello
I got the following response to my easyjet claim this morning. Is technical reasons enough for me not to get compensation??
I am very sorry to hear about the cancelled flight on 09th July, 2010. easyJet work hard to provide our passengers with a punctual and reliable service. I assure you canceling a flight is always the last resort as we understand how frustrating it is for you. In your case, unfortunately we had to cancel your flight for technical reasons. A situation like that is considered, under our Carrier's Regulations and European Law, to be outside our reasonable control. For this reason, I'm afraid we cannot offer you any compensation.
Thank you for taking the time to get in contact with me and let me apologise again for the inconvenience.0 -

This has been asked before and the consensus of opinion is that a named passenger is a named passenger and therefore entitled to compensation. It hasn't been tested in the Courts yet though, and IMO would be a test case and challenged all the way by the airlines.
Are 'infants' actually named on a booking? The ones that sit on your lap for approx £15 or something, I mean.0 -

Also, how much notice did EJ give you of the cancellation? Were you stranded somewhere? Did you get home? Or were you re-routed?
A lot more info need to be given please elster.0 -

Hi Mark2Spark
Thanks for getting back to me.
I used ther standard letter template from this website so yes it refererred to EU261 regulation and included flight numbers, dates, times, passenger names etc.
We were informed our flight was cancelled when we arrived at the airport for check in so they didnt give us any notice. We were told we could get a flight 24hrs later from the same airport (stansted). As we were only on a weekend away (stag do) to portugal we asked if there was any other flights available that day and the only one was from Liverpool at approx 5pm i think. So we travelled to Liverpool by train to get this flight. We received compensation for the train tickets back in 2010 after we got home but we have not recieved any flight copmpensation.
Any further advise will be gratefully received
Thanks

They haven't given you any detail as to what the EC was that led to the cancellation, so at the moment they are denying a valid claim.
Your next step is a letter from the FAQ's that is the NBA letter.
I take it you arrived at your destination later than 3 hours from the original flight time? And that the Liverpool flights were free of charge?0 -

Great thanks for that, i will try and find the NBA letter now.
Yes our original flight was due to depart at 06:45am so we arrived way over 3 hours late.
Yes the flights from Liverpool were free of charge.0 -
Yes you appear to have a valid claim then.0
