    You can bet your bottom dollar(Q JP analysis) , that the Birds will file for a 'stay' until after the appeal, if granted, has been heard.

    ohh and BTW, that's what they've done in my case, it will be interesting to see if the DJ agrees to a stay.

  • We have a flight delay claim with jet2 going back about 18 months. After to-ing and fro-ing with jet2 for a couple of months the claim was passed to the CAA. They wrote back a month or 2 ago saying they had passed the complaint back to Jet2 to reassess their original finding but we haven't heard anything from them (and we don't expect anything from them either). I'm considering now going done the small claims route and I've been watching the recent postings about jet2's appeal.
    Would you recommend hanging fire for the outcome of this or just get the ball rolling.

    Hi Steve,

    I would definitely recommend you start proceedings, don't forget the Notice Before Action, search on-line practice directions 7.1 pre action conduct, or just read through this thread, its all in here.

    By the time, your case goes through the court process, we'll have a better understanding if ALL cases are getting 'stayed', but for now start proceedings Steve.

  • ...and the result was? Written judgement in 28 days! Aaargh!
    7. Whilst she did this, Counsel and I chatted and I opined that, were I Mrs Judge I would want to have a good think. This she did and we await with bated breath! :wall:


    Mrs Judge had said that she would deliver her wisdom in 28 days. After 28 days of silence I enquired of 2Birds (we are quite friends by now!) if they had heard anything. They had not; today they came back to me and said that they had enquired and been told that the Court 'hoped that judgement would be delivered in 2 months'.


    Can the Court do that? Well obviously yes it can. My guess (and if you have another feel free to mention it) is that they have decided to await a Huzar Appeal.


    A thought.... were I a low-cost airline, or indeed any airline, I would be thinking that if Huzar stands my business model is out the window. Therefore, I will appealing it all the way. I would also be joining my chums in the industry and lobbying politicians like mad!


    So no news is - um - no news...
