It's an interesting one.
I think this posting by Mark2spark is a very good starting point.

The obvious conclusion is that since the weather issues didn't affect your flight - but rather the one that was 'forced' into Manchester the previous day and the abortive transfer of the plane from Manchester to Leeds Bradford - that shouldn't provide them with a defence.
I'm not sure if the air traffic point is then a valid defence or not. Assuming that it was potentially, my questions would be what was the extent of the problem (eg a 5 minute incident or 5 hour) and how did it affect all the other arrivals and departures that day? A quick google search doesn't bring up any news reports of the incident so maybe not very prolonged or serious.
I don't think you have the easiest fact pattern for a claim. I'm sure someone can add something more helpful.
Interestingly, wider air traffic control issues were reported the previous day (computer related):

Obviously a defence cobbled together in haste!0 -

I was right!Centipede100 wrote: »Firstly, your flight was technically cancelled not delayed as you flew from MAN rather than LBA.
I did wonder about that point. Looks like the case is therefore very much in your favour.0 -
hi, thanks for your prompt replies, it was this flight that I was on that was delayed.accordingly, and due to the reactionary delay, the flight subsequently departed PMI at 20.55 UTC (22.55 local time) on the flight date and arrived at LBA at 23.35 UTC the sane day (00.35 local time on the 27th September 2008 ), incurring arrival delay of three hours and 20 minutes.0

Whoops! We were a bit too quick off the mark!
I think Centipede100's main point still stands - but I'll let him speak for himself!0 -

(g) accordingly, and due to the reactionary delay, the flight subsequently departed PMI at 20.55 UTC (22.55 local time) on the flight date and arrived at LBA at 23.35 UTC the sane day (00.35 local time on the 27th September 2008 ), incurring arrival delay of three hours and 20 minutes.
It is averred that the delay to the flight was cause by extraordinary circumstances which the defendant could not have been avoided even if reasonable measures had been taken….
Did they call http://www.titan-airways.com/home.html to see if they had an aircraft available? or any other operator?
Seems there were "reasonable measures" that they could have taken.Posts are not advice and must not be relied upon.0 -
hi, I'm in two minds now on going it alone with claim or use a no win no fee company Bott & Co to claim for me.0

My guess is they may not have had flight crew available to re-position the aircraft early enough back to LBA, appears to be their poor contingency planning.Posts are not advice and must not be relied upon.0 -
Has anyone had any compensation from this flight. I'm lot allow to put the link in this post. but you can see it on You Tube (I was sitting over the engine that was on fire).
I have written to JET2 claiming compansation for Flight Delay but they have rejected it 3 times. I tried writing to the CAA but they say it is outside UK. I visited Spanish CAA web site but there is no English translation. Can anyone help.0 -
