Hi JP, at the moment I don't have the info, it is with Bott & Co. I think that they will be depending on the new NEB guidelines, but I will let you know if I get any further info.
That really is some brass neck from Jet2. As P Doff says, Judge Platts was rightly very dismissive of the (April 2013) NEB guidelines. He said:
“… its provenance is unclear and in any event the guidance is just that. It does not purport to be definitive or binding. Whilst it is drawn up by a body whose view deserves some respect, that body is not part of the legislature and is not tasked with interpreting the intention of the legislative body in any particular case. It is not known what interest groups, if any, had input into the discussions”.
I can't remember where we are up to with the NEB guidelines but, if there is a new version, I can't see why the same comments should not apply to those also.

Delighted to say I just received a cheque for £220 for a four hour flight delay in November 2007. Jet2 rejected my claim and the CAA said it was too close to the six year deadline for them to get involved. So I contacted my home insurer from 6 years ago (not my current insurer) as I had legal protection cover, and they pursued the claim for me. Jet2 didn't respond to the solicitor's correspondence so the insurance company decided it was not cost effective to pursue the claim, and paid me themselves!
I didn't have my booking confirmation email from 6 years ago, but I had the reference number written in an old diary, and managed to go onto the Jet2 website and have them email me a copy.0 -

Too late to appeal though JP, I thought you were thinking of having another go, via your daughter? You could be her legal representative.
It's fairy obvious in the light of recent judgements that your judge misunderstood the legislation. In less than 28 days we should have a good result from Dr_A so I'd go for it if you want round two...

Might make you feel better, but what's that saying 'Water off a ducks back'. He's propbably heard all about His Honour Judge Platts by now, and if I get the same DJ, I'll certainly be pointing it out.
On a different subject, when I started my case against Jet2 I made the error of claiming for myself and my wife, but didn't mention her name on the claim form and of course the Birds are claiming 'locus standi' I've done the usual I paid, my debit card, sole bank account, lead passenger et..etc...
BUT... Mrs NA really doesn't fancy a day in court and she doesn't want to have a day away from her work, she has written a letter to say I have authority to act on her behalf. I would be interested to know what members think, should I bring her along to the Court? Would this really be an issue?

I know I should get out more, but the thought of translating TTB or LDO into other languages amused me. I can't decide between Dutch and Haitian Creole. Hmong came third.0 -
