...and the result was? Written judgement in 28 days!

In light of recent developments, that's ridiculous!
I made quite a thing of Jet2 having old aircraft that went wrong quite a lot, with references. The Jet2 tech chap hadn't read the references and the Judge indicated she was going to ignore this.

Hm! So standing up for the individual vs the large corporate then?!
The judge seemed very keen on the Enforcement Bodies list.

Heaven preserve us! Presumably you included the defence against that nonsense in your papers?
Locus standi was a problem. ... She said the others should claim themselves.

Are the courts not busy enough?
Counsel spent a LOT of time rubbishing Platt, clearly, and in so many words, inviting the Judge to 'overturn' it.

Like others, I'm intrigued to know how on earth he could find a way to do so. If you could explain when you have got over today's experience, I'd love to know!

Although it's disappointing not to have got a win today, I would expect that when the judge reads through Judges Platts judgement, she will find in your favour.

Hope not, I'm on the right side of the Pennines - for everything apart from small clams judges, it appears

Counsel spent a LOT of time rubbishing Platt, clearly, and in so many words, inviting the Judge to 'overturn' it. Judge, who hadn't heard of it, took 15 mins for a read.

I find it slightly worrying that this judge hadn't heard of the Platt judgment, especially as it was very recent. Is it not part of the judges' job to keep themselves up to date with current judgments? One would have hoped so.

And now it will take 28 days to provide a written judgment on Dr A's case. Why will it take that long? One presumes Judge Platt was not in error.

From reading other claims how have others been able to get their partners included?

I emailed MCOL & they said
I'm afraid I'm unable to give advice on such matters as court clerks are not legally trained. You may wish to seek legal advice or contact your local Citizen's Advice Bureau with regards to your query.

    Fingers crossed DrA

Unbelievable! How did counsel rubbish Platt?
Judges don't seem to appeciate that it is very difficult for an LIP to actually get any "proof". And should this level of evidence reallly be required at Small Claims level, given the an overiding perrogative is one of "common sense"
Had Judge read Platt before they became so interested in the spurious (and now discredited) NEB list?

It would appear that some Judges are having an opinion before they enter the hearing.
    Well fingers crossed for you.

That's about the sum of it!
Luckily LIP's now have HHJ Platts to throw at them :D

Better a well-researched and reasoned judgment in 28 days once the DJ has had a proper study of Huzar v Jet2 than an off the cuff judgment when, as we have all seen on here, a number of somewhat perverse judgments have been handed down.
    too true...
