I have appealed to Jet2 on three occasions for compensation (same trip) but without success. The last time I was informed that the delay was due to a "Total Air Temperature Probe fault during 'pushback', immediately prior to departure and a replacement aircraft had to be sourced. I was delayed for 4.1/2 hours. I have no means of confirming if this is, in fact, true. Therefore they have declined my claim stating that this is an extraordinary circumstance. Has anyone else had this excuse.0

If you Google and find the ambient air temperature on the day you departed you could do your own calculations as to whether the probe was even required. In order to do your own calculations I post the easy Wikipedia formula

I hope your probe problem was not over 2 years ago as Jet2 are now jumping on the Thomson/Dawson rubbish ....

Why cannot this happen.
If a claim goes to court and it is determined that the fault of the delay was not extraordinary circumstance, why is a Judge now not able to say "that flight LS666 (whatever), is now determined to be a flight that delayed it's passengers and it is not a" extraordinary circumstances flight, compensation is now due"....

The direct answer is because that isn't what the law requires them to do - although it does seem daft.
The real question is why the CAA don't impose that condition, as that probably is within their powers.0
