the permission to appeal Huzar has not been granted with a hearing due sometime in January 2014 to decide if permission should be granted.The above is just my opinon - which counts for nowt! You must make up your own mind.0 -

Yes, I would agree completely. As it stands at the mo HHJ Platts has made a decision based on his legal understanding and interpretation of EC 261/2004. So my advice to the airlines is to pay compensation as due until you can provide evidence to the Courts that HHJ Platts decision was 'fundamentally flawed' as they are stating to me.
It would be interesting to know if Bott & Co are accepting of the Birds requests to stay cases until after any such appeal, if granted, takes place.
I find it a huge gamble on Jet2s' part, if they lose the consequences of this could be very costly. Privately I wonder if this appeal is more to do with the pride of BIG Bird being hurt when he lost Huzar, perhaps he's puffing his chest out and ruffling up his feathers, sad thing is Jet2 are feeding the birds, I was always told by my mum not to encourage them by feeding them! Jet2 will never learn...:eek:

Would imagine it is not 2 Birds / Bott & Co, or our call to make... it will be under the direction of the courts.
I received a pack off 2 Birds approx. a couple of weeks ago, witch contained their request to stay "my own court case" court case.
Point 1... They requested extra time for "permission" to appeal.
Point 2... If they were indeed granted permission to appeal, then they would require extra time until the result of the appeal is know.
My guess...
They will NOT be granted permission to appeal.
They court system will say "Platts was right / permission denied".
Cases will then progress, as normal, back on track, with 2 Birds in a worse position than before they appealed.
Their angle of "defend at any cost"... with no matter of the legitimacy of the claim being taken into account was only going to clutter up the court system, inflate the public / court systems awareness of the issue (s) and by questioning the legitimacy and judiciaries judgements was only going to p*ss everyone off and increasingly stack the deck against themselves as every case goes infront of the each Judge.
In short, I believe the writings on the wall for Jet 2 / 2 Birds way of dealing with this issue...

I agree completely John, in my case the Birds wanted me to agree to a stay of my case by agreement and had already drafted a consent order for me to sign!
Then when I refused, they started to mention the costs involved and I understand that they will be asking for a stay in my case and to recover legal costs.
Apparently they are putting it before a Judge tomorrow without my agreement.
A very typical bully boy approach.
Sad reflection on solicitors profession if you ask me.

I do not know what your opinion of those within the legal profession was before you embarked upon this issue...
Me, I'd have put them at the top of the pile, along with:
Car Salesmen
Politicians
Insurance Companies
Utility Companies
&
Members of the Clergy
(Of course, I would exclude every fine / upstanding member from Bott & Co. from that list)0 -
