  • Hi all,
I would like a bit of advice as how to proceed with my claim.

Following my initial letter to Jet2 in Sept of last year i received the standard reply saying that cases were being dealt with in order etc etc.
Since then everything went very quiet so last week I issued a letter stating my intention to start court proceedings if i did not get a satisfactory reply within 14 days.

I have now had a reply saying that it will take time to process and investigate my case and that it will be dealt with in strict date order.

What are you thoughts on this? Do I just sit and wait?

    Many Thanks
    Brett

To be seen to be reasonable unlike Jet2, write again, point out you submitted a claim 9 months ago which more than enough time and ask for a definite date by which your case will be examined and paid out.
But give them a date you expect it done by, say 4 weeks. After this date you will submit lititgation papers on week 4, day 1.

You have to be specific, not vague or open ended, otherwise Jet2 will play you.

    Hello All.

Bott & co have been managing my claim since June 2013. (Stout Fellows !)

Flight was August 2009... Malaga to Manchester. 24 Hour Delay. Jet Dos.

Flight Actuator - Technical Fault caused the delay.

(Flight safety shortcomings, then Montreal Convention, then 2 Years to claim under T&C's have all been cited as a reason not to pay)

Bott's have got a court date in early August. I have a couple of questions...

Why do you think Jet Dos are continuing to fight this case ? They must surely know "they are on a hiding to nothing"

Does anyone think it will get to court ?

    or

At what point do you think Jet2 will fold ? (Court House Steps ?)

Jet2 Fan. No-one on here can answer your questions as we don't know the circumstances. Why don't you ask Bott and Co? They are your solicitors and know all the facts of your case. You are paying them to work for you

It does seem strange that Jet2 have not settled this one, I'd leave well alone at let events take there course, most cases (not all) are NOW getting settled, I suspect that as the actual Court date gets closer, you'll receive a letter from Botts confirming your compensation.

    Cheers,

  • My case is still in the court system.

But I know of people who had a date and wrote to 2bs and invited them to settle and they did.
  • More bad PR for Jet2. There have just been some holiday makers interviewed on the R4 news about the Tunisia incident and how the other operators have flown their customers home and Jet2 had done nothing; no information or support.

there is now information on their website and flights bringing people back (they say people are on their way to the airport)

Further to my post (2364) of 22/6/15, I now have a few more details of my payment from Bott & Co.
I was puzzled why the amount awarded by the court was more than our joint claim of €800 (400x2).
It seems the court awarded 'Interest' to the amount claimed, presumably because of Jet2 delaying payment for so long. This interest was £111.99. However, Bott's terms and conditions do say that they will be entitled to keep any interest awarded, so lucky them.
They say that the 'Disbursement Fee' is the cost of taking the case to court. This was claimed directly from the airline and was £70. So it appears they get to keep this also.
'Fixed Cost - £70' is apparently the solicitors' costs, which they incur directly from the airline (bit puzzling that one).
Summing up, they confirm that my claim was for €400 - which they convert to £342.58. Then they take their 27% (£92.50) from that leaving £250.08.
Finally they deduct their 25% Admin. Fee (i.e. £250.08 less £21.40).
So my final payment was £228.68.
The joint claim they handled for my wife and I therefore resulted in a total payment of £228.28 X 2 (£457.36).
I worked out that after they had paid the £61.16 to the VAT man, Bott earned £479.80. That's £22.44 more than they paid to us, but I guess it could be worse!
However, I think a few will be surprised to learn that the company ends up receiving more than the client. Like others, I thought that their 27% cut would be covering items like solicitors' costs and other incidentals, particularly as they enjoy the benefits of any interest awarded.
