I would expect legally they can't do that. I'll reply in a few days after investigating the rights regarding a SAR a bit further.

    Have a look here:

    http://www.ico.org.uk/for_the_public/personal_information

There is a section 2/3 of the way down the page entitled "What can I do if the organisation does not respond?" which may be helpful.
  • When I was courting my fiancee I regularly travelled from Newcastle to Malaga, as that is where she is from. One time on my return flight with Jet2 the flight was delayed approximately 5 hours. I did not realise I could claim for this until now and as such took no further action. Now, however, I would like to claim, but I'm unsure as to what flight it was. Using "my Jet2" from the company website I have narrowed it down to 3 flights

I suspect it is probably the flight in September but I'm unsure. Is there anyway to find out, is there a webpage that documents delayed flights?

Thanks for your advice and help

I was delayed for 5 1/2 hrs on a flight from Manchester to Cyprus this summer. We boarded the plane on time. The pilot when we first boarded the plane stated it was a computer error. The plane was safe to fly but would use more petrol. He wanted to get the computer fixed so after 15 mins we all got off the plane. We were told we had 45 mins to go and get a coffee then please be back at the boarding gate. This we all did. 4 hrs later we were told we would now be using a different plane and could we all go to a different gate. After 5 1/2 hrs we took off on a bigger plane. We were all given 1 free bottle of water but the plane had no food on to buy except chocolate and crisps as it was a different plane and a different size. I have sent the company the letter that is on Martin Lewis's website for compensation but the airline has written back stating we are entitled to no compensation!!! Were were offered no food or drinks vouchers in the airport and only the water on the plane. My understanding is we should have been offered food and drinks vouchers at least and as the plane was safe but it was the pilots choice we are entitled to compensation. Any advice please?

You should have been given a voucher for refreshments after 2 hours delay along with a letter explaining your rights to possible compensation. Clearly a choice by Jet2 to not fly so not exceptional circumstances and compensation due. Unfortunately Jet2 will probably not pay you what you are due and you will have no option but to take legal action or appoint a NWNF firm, such as Bott. Or walk away.

Not walking away. If they had apologised properly or offered vouchers for food in the first place then I wouldn't have bothered but after their treatment I will fight it if I can.

Well if you find a personal claim too daunting or time consuming at least engage a no win no fee to achieve just short of three quarters of the money Jet2 owe you.

Did you purchase food and drink whilst waiting, you should be reimbursed for this if you send in receipts.
Not sure whether Jet2 have paid anyone out to date without court. I have given mine to Bott and co but even then it does not appear to be going anywhere
"The airline has previously denied any liability to compensate the passengers on this flight.
We are not yet in a position to issue court proceedings on this claim, however we will continue to review the matter every 28 days."
be prepared for a long slog

Just a word of caution RE: The above post.

Be careful as to the percentages / fractions you qoute of the compensation awarded.

My own claim (now five years old.)

Malaga -> Manchester (Me, wife 3 kids)

    If / when we win, I would get 300 Euro x 5 (Approx £1100.00)

    Bott & Co will get:

    25 Euro per person
    27% Of Claim Amount

PLUS: THE INTEREST: 8 Percent Going Back 5 Years
    (If awarded)

Bott & Co will end up with about £1300.00

That is the deal you sign up to, when you allow Bott & Co to do the work for you. I don't begrudge them what they will get.... Mainly because they are doing the donkey work.

I just thought I'd point that out.

Assuming they get 8%;) So about 475E without interest?
