Hi, help would be great as I don't know what steps I need to take.
    Flight on 25/9 0625 BFS->STN RK128
Flight was delayed, departure board stated estimated departure 13:50 (Eventually left at 11:58) Flight arrival time was more than 5hrs after it was scheduled to arrive.
Upon discovering large delay (7hrs) I quickly booked and travelled on an alternative easyjet flight as suggested by Swissport staff.

I'm bewildered by the lack of clear steps to follow for compensation. I'm hoping to get the delay compensation, and getting the alternate flight re-imbursed would be good. When choosing the 'Compensation Only' option on Ryanair's EU261 Claim Form website, it will not let me proceed (perhaps it is because I did not board the flight). If anyone knows what are the best steps to take?
I don't believe you'll be entitled to compensation if you chose not to travel on the delayed flight, and am not sure that you'd even be able to claim the incremental cost of the other one if you booked it yourself without referring to the airline.  Did Ryanair message you about the delay and advise you of options, such as a refund perhaps?
The comms from Ryanair via their app were generic and did not mention any procedure other than £3 voucher for food/drink. There were no Ryanair staff at the airport. The Swissport staff that seemed to be dealing with enquiries said that there were no other flights from Ryanair and that you could book the flight which I booked, but would have to do this yourself. Talking with Swissport, they believed that compensation should be available due to the flight being over 5 hrs delayed and that it was a technical fault with the aircraft. However it seems unclear what can be claimed and how, as I read differing opinions?

You're only eligible for the delay compensation if you travelled on the delayed flight. You didn't so you won't be entitled.  You may be able to get a refund of your unused Ryanair flight though if it took off more than 5 hours late: When am I entitled to a refund? – Ryanair Help Centre

Ryanair do not deal with third parties until you have exhausted their procedures. This is to avoid you paying for services that are not necessary.

    Esk's link should be helpful.

Same here, Ryanair wouldn't reply at all, my claim was done through Resolver. What would be the next step, please? Try to fill in the 261 form on their website? Thanks

My post was specifically in response to the comment about their refusal to accept the bank details, but yes, if you've unsuccessfully tried using Resolver to circumvent claiming directly on the airline website, that direct approach should be your next step.

Check the IBAN/Swift code information given. I suspect what you have entered is incorrect.
  • Hi,
I've made a complain though their website and Ryanair responded very quickly.

"Following a review of your claim, we regret to advise that no liability to compensation arises under the EU261 regulation, as your flight was delayed due to adverse weather conditions, outside of the control of Ryanair, and our position remains final.
If you are unhappy with our decision, you can take your complaint to your local ADR body."

Our flight was from Bucharest to Bristol and the our aircraft due to come from Bristol had another flight to Dublin but because of adverse weather couldn't land so they had to divert it to Belfast eventuall (after was in the air for quite a while). All this delay was added to the flight from Bristol to Bucharest as they didn't have another aircraft available. The flight was scheduled to arrive in Bristol at 23:25 but we got back at 03:00 AM.
Where can I take it from here?
Log a complain with ADR? Is there a template for that or just a form to fill in?
    Thanks
  • Just found the link for ADR
"The complaint form asks for you i) your personal details ii) details of your flight (such as the departure and destination airports, flight number, time of flight and airline and iii) details of your claim and evidence in support.

The adjudicator will make a decision based on the information and evidence provided by both parties. It is therefore vitally important to your claim that you provide full and accurate details and as much evidence in support as possible. Failure to do this will jeopardise your complaint.

Once you have submitted the form you will not be able to submit any further information or evidence unless we invite you to do so. It is therefore important that you do not submit the form until you are certain that it is fully completed."

I've got some print screen shots showing the flight delay and the 3 emails from Ryanair regarding the delay departure but they didn't mention any reason for that. What othger evidence do I need to provide to ADR?

    Thanks

Edit: cross-posted, you found this independently!  In terms of evidence, as well as any communications from Ryanair, both at the time and in response to your claim, you should supply anything that endorses why you're challenging Ryanair's rejection.  For example, if you're disputing the severity of the weather conditions earlier on, then what supports that, or if you're suggesting that the knock-on delays were within the airline's control then you'd need to make that case with as much evidential support as possible....
