I don't think the rules cover the scenario for inadequate replacement flight.
In our case the flights back to Stansted were replaced by flights to Rome only because Ryanair could not offer replacement direct flights or indirect ones within a reasonable time scale and quoted 7 days ! They did not make any attempt to arrange flights via a budget partner airline and placed responsibility for this on us. We tried all airlines and BA Economy flights were cheapest available according to the comparison sights. Did the airline not have a responsibility pay to reroute us to the first departure point at their expense in these circumstances ,rather than just transfer us to Rome approx. 1/3 of journey home?0 -
I think you have a case as Ryanair clearly were not going anywhere near "intolerable sacrifices" to minimise your delay. You were offered either a weeks wait for the next flight (fails second hurdle of any court test) or a flight not to your original destination with NO offer of any further flight from Rome to get you home. Just because they got you on flight doesn't exempt them from the regualtions. In fact it probably makes their potential defense weaker as the ATC was such a short time (4 hours?) and known in adavnce, RA could have made alternative arrangements. They chose not to, an operational decision, not an EC.
I'd get your NBA in then start reading Dr Watson's excellent notes on the ESCP process before submitting a legal claim.If you're new. read The FAQ and Vauban's Guide

Ryanair have been ignoring me regarding the compensation, despite the CAA saying they should pay me.
I already sent them a final notice, but I got a job out of the country and moved to Asia. Can I still apply for the small court against them in UK from abroad?0 -

Do you have friends/family that are domiciled in the UK? If so using their address could be a way to instigate ESCP for yourself.
Be aware though of the slim chance of needing to appear at a UK court.....that's a long way from Asia.
Good luck and keep going.Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

Thank you for this information. I may run with claim for uninsured losses via Legal Expenses Insurer . In mean time I have discovered some proof that Ryanair were aware as early as 6 April 2016 of planned Italian ATC Strike for 9 April 2016 according to FLIGHTWORX as reported below :-
Italian ATC Strike - 09.04.16
6th April 2016
NMOC has been informed by ENAV (Italian ATC provider) that an ATC industrial action has been confirmed on 9th April 2016.
Due to industrial action of operational personnel some air navigation services may be affected.
Latest NOTAM indicates that ATC industrial action will be effective from 0800-1200 UTC.

If you aren't up against a time limit, maybe use their claim form so that they have one less objection to raise. Not sure how Resolver works but assume you can switch to that later if you aren't having any joy. I'd be surprised if the approach that you took would determine the ultimate outcome so I wouldn't worry too much. Just get the ball rolling.0 -
Like he said. Do their claim form, make a copy of it. Give it 4 weeks. When you get no reply use emplate letter, making it your NBA and give them 2 weeks. In the meantime to read up on Dr Watson's excellent ESCP claims notes.If you're new. read The FAQ and Vauban's Guide
