    Hi Forum users

    Some advice please

On the 19th June 16 BA cancelled our flight home from Madeira to the UK. They only fly once a day on this route. They blamed this on the Unofficial French Air Traffic control strike.

Also any thoughts on my EU compensation claim success rate?

    Thanks

    Hi Calculus,

    Thanks for re posting.

Firstly, what date was your flight on? Possibly the 9th?

If BA can prove that the cancellation was due to a French ACT closure then it would exempt them from having to pay EU261 compensation.

However, it would not exempt them from their duty of care to ALL the stranded passengers.

Please do a Google search for Vaubans guide, download it and have a good read. You will then have a good idea of what you may be due and how the regs work.

Also read this recent article from the EU Commission which reiterates quite clearly what the airlines should be doing.

    http://ec.europa.eu/transport/themes/passengers/news/doc/2016-06-10-better-enforcement-pax-rights/c(2016)3502_en.pdf

Aircraft flying from different parts of the UK may not have been required to fly into French air space in the first place. From the SE I believe they normally would. Thats not to say that they couldn't have re filed a flight plan to avoid French controlled air space.

Post any follow on questions here and good luck.

  • Hi
Can anyone help? Any advice please.
BA flight from Bangkok to London delayed by 2hours 30mins which meant we missed the last connection of the day to Manchester. BA put us up overnight and we travelled on first plane the next day.
Missed day at work as a result.
Captain on the Bangkok flight said delay was due to technical problems in London before take off.
Compensation claim rejected by BA as they say it was due to a health & safety reason being they found a mouse onboard and swapped planes.
Is this acceptable as a health & safety reason? Is this still not BA's fault?
    Thanks

    Hi,

It sounds like you have a legitimate claim to me. This type of problem is inherent within the operation of an airline and therefore, is not an extraordinary circumstance.

Look at the post above this one and follow the same advice. i.e read Vaubans guide and also the link.

You could try the resolver tool but I would issue an LBA as that is the route to a result, resolver can be ignored and drag on.

    Good luck.

  • Hi. I would welcome your thoughts on this please -
British Airways Business Class Flight from Manchester - Heathrow - Vegas. The Manchester flight was cancelled and alternative also cancelled (due to the weather?). BA representative at Manchester airport offered alternative next day flight but could not guarantee if the flight to Vegas would be in Business Class or if on a BA plane
    + overnight accommodation.
At this time they had tried to get taxis to get us to London to catch our connections, but due to it being a Bank Holiday Monday, they could not get a reply. As my Vegas flight was not till much later, the BA representative said I could catch a train to London, keep all my receipts, and I could get a refund on my return to the UK so following her advice, this is the option I chose.
I am now battling with BA who will not meet my expenses claim and I have done exactly what I was told to do. In my opinion, I chose the cheaper option as an overnight stay, the loss of a day's holiday + the possibility of a refund for my Business Class seats would far outweigh the cost of rail travel.
    I welcome any feedback please.

I think I may be able to claim compensation. I was supposed to fly Warsaw - Heathrow - Edinburgh at 11:50 on the 13th. We were told 'delay due to a technical problem' for hours, then we were told the flight wouldn't be flying today, we were told that our flight would be at 6AM the next day and to be at the airport for 4AM, and we all had connecting flight re-arrange assuming we'd be leaving Warsaw at 6AM. So we all arrive at 4AM, only to be told that no our flight's at 8AM, not 6AM. Of course, all the connecting flight we'd been given yesterday we'd miss. Anyway, we ended up eventually leaving Warsaw at about 9:30AM on the 14th. Arriving in Heathrow I had missed my connection to Edinburgh so had to wait in another queue to be placed on a different flight.

Long story short instead of leaving Warsaw at 11:50, leaving Heathrow at 15:15 and arriving in Edinburgh at 16:40 on the 13th, I actually left Warsaw at 9:30 (although the flight was scheduled for 8), left Heathrow at 13:15 and arrived in Edinburgh at 14:40 on the 14th.

So I had a delay of 21 hours 71 minutes on the flight from Warsaw to Heathrow. And because of that I arrived in Edinburgh 21 hours and 59 minutes late.

So I assume I'd be able to claim compensation since I was delayed more than 3 hours. Would the amount of compensation be based on the distance between Warsaw and Heathrow (which is less than 1500km), or the distance between Warsaw and Edinburgh (which I assume is more than 1500km)?

Would I also be able to get a refund on my ticket? I booked directly with BA on their website. I paid 754.47 Polish Zloty for the Warsaw - London - Edinburgh flight.

I have screenshots of the BA app that shows all the flights I was scheduled on (here), and a screenshot of the Warsaw - London flight showing the scheduled and actual departure and arrival times (here).

Since you used the ticket, no.

You are due compensation on the total journey ie your final destination. Did BA arrange accommodation and pay for it?

So the flight distance would be Warsaw to London (1471) + London to Edinburgh (534) = 2005 km? So 400 Euro compensation?

Yeah they did. Well they paid for it, but the airport staff arranged it since there is no BA representative at WAW at all. We got a hotel room each and with free dinner, and the day before when we were waiting 4 hours being told delay after delay we got a box of juice and a sandwich.
