Good result.
I have to wait until 5th July to see what CEDR say.
The letter I have from Tui stated flight crew limitations, but for some reason their only defence to CEDR was a weather forecast for a few days before my flight, showing no snow on day of the outbound (I was the follow on inbound).
I queried why they sent a weather forecast with no explanation when the letter I have and sent to CEDR was flight crew limitations...
Whole process is strange as now we have another 4 weeks since last flurry of mails for the adjudicator to decide...0 -
GREAT NEWS! The CEDR abitrator has found in our favour on all counts and instructs TUI to pay 800 euros in compensation. Now the wait for payment which i dont expect to be quick!
To be honest the sole defence of TUI ‘crew flight time limitations’ i dont think left the arbitrator with any other option.

shug61 probably come back to you with decision quicker than 4 weeks. Mine said deadline 30 june but email sent 30 may said within approx 14 days and received result 15 june. Sats they have 20 days to pay. Wishful thinking?0 -

DISCUSSION OF DECISION: The passengers claim succeeds in full. I direct the airline to pay the passenger the total sum of Euro1,200.00 in compensation. The conversion rate from Euros to Pounds Sterling shall be in accordance with the exchange rate published on the European Central Bank website on the first working day of the month in which this decision is issued. .
Long process but fair handling by CEDR. Seems flight crew limitations isnt an EC

Good to see CEDR maybe getting its act together but I'm still not convinced.
Maybe Tui will also start to do what they are legally obliged to do instead of ignoring the law and CEDR decisionsIf you're new. read The FAQ and Vauban's Guide

What is frustrating is the need to go through the longer CEDR process when TUI know they have no case. It is very clear TUI are just hoping people just go away as many must do upon initial decline.
Action should be taken or greater penalties imposed on airlines where a case is referred to CEDR and they lose to avoid wasting everyones time. I believe the banks pay something like £400 for each case refered to the financial ombudsman so it is in their interest to setlle a claim prior to referral where it is clear they are in the wrong.0 -
As far as I am aware there is no legal requirement to use CEDR Just go straight to the small claims court.0

I am in same position as Shug61 having recently had CEDR adjudication in my favour for 'crew flight time limitations' so I would expect you to receive same outcome if that is TUI own defence.
I am now awaiting contact from TUI re payment (CEDR say 20 days but reading on here I expect this to be longer).
TUI may offer vouchers but you can insist on cash as alternative.0 -
Hi I wonder if someone could advice me? On 10th June I was delayed for 7 hrs in Malaga airport to return to Bristol. When we finally boarded the plane the pilot told us that when the flight left Bristol for Malaga it had to land in Gatwick dur to a cracked windscreen. At this point they had to source a new plane, they could only source a Dreamliner which subsequently needed a different pilot and crew. This took time hence the long delay.
Is this something i can claim for or out of the airlines control?
