    If the circumstances are as you tell them you will all get 600 euro but no compensation from the airline for missing 1 days holiday. Check that with your insurance.

    Thanks for your reply. All the details I mentioned are correct - am I right in thinking (having read other posts) that we will be unlikely to receive anything for quite a long time? I will check our travel insurance to see if we are able to claim for the first day of our holiday.

    Tankard, the point is that compensation paid under the regs is supposed to compensate you for the delay and inconvenience etc. Before the regs were passed you'd get nothing at all, other than through your travel insurance.

    It’s a long drawn out process, and initially I think Tui and other airlines hope you get bored and give up.

    I had numerous mails over a couple of months with Tui and in the end they referred me to CEDR.

    I uploaded info to CEDR and they then have (I think) three weeks to review. They then asked for more data and gave the airline three weeks to respond. Tui responded on last day with just a weather forecast map of the period, but no other info, no comments, and this was for the original Tui letter (handed as we got off the plane) saying it was flight crew limitations.

    I then submitted the actual weather for the day from a download, that showed sunny and no snow for 24 hrs previously.

    My case now with CEDR for adjudication, with a deadline to decide in three weeks from now, so early July. Been 4 months now and hopefully nearly there.

    No idea if CEDR will rule in my favour, but as flight crew limitations not an EC am hopeful, although Tui seem evasive and sending confusing responses to CEDR as well as me. Pretty sure they just try and create a smokescreen and hope you go away.

    I guess above all else I'm just looking for advice on the expectation of my current claim which I submitted

    Original flight was scheduled for 13:00 on 29th may however we were told on arrival of a delay until 17:10 at which time we boarded the plane. We were told at that point that the initial aircraft scheduled to take us had broken down in costa Rica and this was the earliest they could get the replacement to us

    After 15 minutes the captain then came on again and said that there were further delays due to inclement weather across Europe and we would need to stay on the plane for another 2 hours before scheduled take off, but this might get brought forward. Eventually we took off at 19:30 and landed at 01:13 - 5 hours after we were originally due to land

    My concern is that tui will of course blame the whole delay on the weather (and therefore not be eligible) and I wondered if there is anything I can do or any tips now ahead of this expected response ? I have submitted my initial response via resolver. Perhaps I am being pessimistic ?

    Hi Sleighton123,

    No they won't be able to get away with that as the initial delay was due to a none EC tec fault with a flight previous to yours. That initial delay took you over the qualifying 3 hour mark so regardless of later weather related problems you are still due compensation.

    I have an issue as to the time the doors were opened on my delayed flight. The recorded time is just under 3 hours late landing but I know it was quite a bit longer until we could exit the aircraft.

    The airline have ignored my requests for this data.
    All the online stats show the landing time it seems. Have tried bottomline and euclaim but they say I cannot claim presumably as they use the same data.

    I did not know until recently (thanks to MSE) that the delay is measured on the time one or more doors are opened not on the landing time so I had not pursued the matter but it is annoying that I cannot even get my airport food and drink expenses back.

    Is the door opening time recorded anywhere official ? Can anyone tell me how I might find out the accurate door opening time please ?

    I know that's how it should work in theory but i'm just concerned based on others experiences they will just group both into the one so they can wriggle out of it.

    Is it simply my word against there's as it stands

    Duty of care kicks in for delays over 2 hours so you should be able to claim this back.
