Thanks for the info. I did post a TUI specific question on the TUI thread but I now want to try to find out if there is a way of getting confirmation of exactly when a flight opened its doors. This would apply to any delayed flight so I think I am in the right place. Apologies if not but hope you will understand my logic and that I did consider the guidelines first,0

Firstly I would like to thank those who have provided great advice on this forum. Although I haven't posted my own flight delay before knowing that others are fighting the same battles really helps - so thank you all!! :beer:
My case is a 26 hour delay on TOM7673 Sofia to Birmingham
Scheduled departure: Sat 3/03/18 16:40
Here is my progress so far
Raised with Resolver: 5/03/18
TUI letter received: 10/04/18 reason - due to flight time limitations
Escalated with Resolver repeatedly.
Raised with CEDR: 4/5/18
TUI letter received refering to CEDR the day after rasing with CEDR.
CEDR initial response: 25/05/18
TUI response to CEDR: 14/06/18 - still claiming flight time limitations but also saying airport closure outside their control.
Currently appointment pending with CEDR deadline 19/07/18
There was an airport closure overnight at Birmingham 2/3/18 to very early 3/3/18 but both airports open 8 hours + before flight scheduled to take off. Ryanair had a flight make the same journey at a very similar time to when we should have been flying so I don't see that the weather or previous runway closure would have caused the delay. The outbound plane was empty so I suspect it was reallocated else where.
This whole process has taken quite a long time already (3 months +) but I do want to keep going with it as the treatment of passengers by TUI was terrible. It was a constantly increasing delay so we ended up in the airport for 10 hours that Saturday and the lack of real information was the worst part. :mad:
All I can do now is wait for the CEDR decision but hopefully my timeline can help someone else know what to expect.0 -
I am just wondering if anyone has had any similar experiences in difficulty in obtaining payment from TUI even once the Judgment has been made? The Adjudicator ordered TUI to pay £1,400 to me in respect of my claim and ordered that payment be made by 01/04/2018. I am still yet to receive payment. CEDR have been chasing the payment on my behalf and I was told over two weeks ago that a bank transfer request had been raised to send the funds to me. Almost three weeks later now and still no payment has been received. Does anyone have any advice please?0

Yes, send them a Letter before action and give them 14 days to pay if they don't pay within 14 days issue proceedings against them in the small claims court.0

Tui must believe that crew flight time limitations is their best line of defence as they appear to be using that in many recent claims on here.
Myself i am still awaiting adjudicator decision due by 30 june.0 -
Flight time limitations? Surely it’s completely within the control of the airline to manage staffing (and ensure there are enough stand-by crews) so their flights can actually fly!0

I would agree it just seems obvious what TUI tactics are.
Anyway I have provided my final comments to CEDR and now await adjudicator decision by 3rd July 2018.
I can't see how CEDR can validly agree with TUI reasoning which in my case was solely referred to as 'crew flight time limitations' with no other evidence submitted to support their defence.
GREAT NEWS! The CEDR abitrator has found in our favour on all counts and instructs TUI to pay 800 euros in compensation. Now the wait for payment which i dont expect to be quick!
To be honest the sole defence of TUI ‘crew flight time limitations’ i dont think left the arbitrator with any other option.0
