    Hi all,
    I am currently away on holiday but checked the mcol website today and noticed a change that I don't understand.
    It states....
    - the defence was struck out on 20/7
    - the bar in place for Thomson airways was removed on 20/7

    Can someone explain to me what that means? And also if I am required to do anything now, bearing in mind I'm not back in the UK for another two weeks

  • After 2 years of trying for compensation for a flight delay to Mexico after the plane broke down on push back I have finally got my €1200.
    I tried the route of doing it myself, it took 6 months for a reply which then got rejected I went down the route of complaining to the CAA who again took 6 months to reply and told me to take my complaint up with thompsons,
    I then passed it onto a flight compensation company who got know where with it and basically wasted 1 year doing nothing but sending letters and waiting for a reply which never came.
    Yesterday I contacted Pickwicks solicitors to take on my claim, I e mailed the no win no fee form off at 10am today and by 5pm I had an e mail back saying Thompson had offered to settle my claim in full.
    I would 100% recommend Pickwicks even if you pay 25% to them but if your getting know where fast with a thompsons it's worth a try.

    Well thanks to Vauben and others for helping me with my claim. Thomsons have paid me out...one template letter with the correct details and boom £800+.

    BUT...We are a family of four 2 adults and 2 children (6&2) which we paid for etc.. they had there own seats.

    The letter from Thomsons says we qualify for compensation payments of 600 euros per person on your booking (excluding infants and free child places).

    They have sent a cheque for £800+ which is only for the adults? Not the children? We didnt have free child places.

    Obviously I havent cashed the cheque and I will be replying to their letter, can someone 'link' or point me in the direction for the correct law so I can include it please?

    What actually did you pay for your children? If you paid full fair for both your children you are entitled to compensation for both.

    If you paid anything on a normally available fare, for kids then you are entitled to compensation for them too.

    From the 261/2004 regulations....

    Article 3
    Scope
    1. This Regulation shall apply:
    (a) to passengers departing from an airport located in the terri- tory of a Member State to which the Treaty applies;
    (b) to passengers departing from an airport located in a third country to an airport situated in the territory of a Member State to which the Treaty applies, unless they received benefits or compensation and were given assistance in that third country, if the operating air carrier of the flight concerned is a Community carrier.
    2. Paragraph 1 shall apply on the condition that passengers:
    (a) have a confirmed reservation on the flight concerned and, except in the case of cancellation referred to in Article 5, present themselves for check-in,
    — as stipulated and at the time indicated in advance and in writing (including by electronic means) by the air carrier, the tour operator or an authorised travel agent,
    or, if no time is indicated,
    — not later than 45 minutes before the published depar- ture time; or
    (b) have been transferred by an air carrier or tour operator from the flight for which they held a reservation to another flight, irrespective of the reason.
    3. This Regulation shall not apply to passengers travelling free of charge or at a reduced fare not available directly or indirectly to the public. However, it shall apply to passengers having tickets issued under a frequent flyer programme or other commercial programme by an air carrier or tour operator.

    My daughter applied for compensation in 2013 for a flight she was delayed on in June 2011. After sending template letters & filling out forms & sending proof etc she had no reply & we forgot all about it.
    I came across the paperwork in April this year when cleaning out a drawer & completed the online form for her. The standard reply said she would have a response within 28 days, when that time passed with nothing I emailed again & was told they were working on it & they would be in touch soon.
    Imagine her surprise today when she opened a letter & received a cheque for £284 (400 euros) which is exactly what she claimed.
    Thank you to everyone involved in this thread for making us aware that it is possible to get this compensation with only a few forms to fill in & some patience.

    When you book a package deal with Thomsons it automatically gives you a free child place if they are under 2. Over 2 it just adds on another per person charge, including flights and hotel. Our children were 6 & 2.

    Unfortunately it doesnt show this in the price breakdown it just has flight + hotel charge.

    We booked an £800 per person holiday x 4. Thomsons sent payment for 2 (excluding infants and free child places)

    I dont have any evidence to send in that I paid for my children.

    I dont have anything to prove I paid for my children as it doesnt show in the price breakdown. It is 'built' in to the total cost. Before booking it says price per person, once booked however the price breakdown only shows flight+hotel.
