Simon - your court fee of £105 is due and Thomson know this - remind them! Whilst reminding them you may wish to suggest that a fair compromise on interest would be say 4% - you probably won't get this but worth a go.0

Brilliant, thanks.
The interest seems to be a contentious subject. Is there a legal obligation on Thomson to pay this?0 -
No legal obligation whatsoever unless matter has been to court and judge said otherwise. There is, however, an obligation for Thomson to pay ALL your court costs and as they are trying to get out of paying those you may as well flag up the interest situation again.0

Personally, I'd let it run to court. Tell the airline their offer is unacceptable. You'll get all of what you are owed, plus very likely the interest as well.0

First started my claim April 2011 for delay from Cape Verde to Birmingham due to toilets not being serviced and flight diverted to Faro to rectify which Thomsons rejected. Following TV program and European ruling resubmitted claim but received no response what so ever.. In May 2014 submitted claim to CAA and received response in Dec 2014 again rejecting claim due to "extraordinary circumstances" which Thomson now claimed to be a fuelling issue. Spoke to Bott & Co. 5th Jan explained the situation and they resubmitted claim. I am delighted that on 1st July Bott,s confirmed that the claim had been agreed. Better still total payment was received on 10th July for £730 for myself and my wife and was more than originally claimed back in 2011.
This claim was never about the money it was the principle as the airlines never seem to accept responsibility for their problems.
My thanks to Bott & Co in resolving this and I would not hesitate in recommending them.0 -
Some hopefully good news hear.
After making myself am all out pain in Thomsons bottom since March I finally heard back yesterday to say that my claim was approved on the 9th July. They would not tell me how much I was been awarded as its a "legal" matter but said I should hope to have a cheque within one week.
I hope the cheque arrives quickly and I shall of course up date then but I do feel this is an excellent forum and the support it provides is beneficial. It really does give you the confidence to fight your corner and remain persistent.
I really do hope everyone waiting for an answer gets some good news soon. We are all entitled :-)Arctic Monkeys :j0 -
After 2 years of messing about with TUI , them either quoting various reasons why my claim had been refused or them simply ignoring my letters I raised a claim in the County Court. Best £60 I ever spent, getting an offer from Thomson within 10 days and the money in my bank account within another 7 days.
This was for a flight from Manchester to Varadero Cuba on 3 November 2010.0 -
Hi
I'm after a bit of advice as to whether we can claim anything for the below situation....
On Sunday evening we were due to fly back from Larnaca to the UK. About 2 hours before we were due to fly out they announced a gate change which we just thought was normal, but then we were sat at the gate for a while and it wasn't until after we were due to have taken off that they announced there would be a delay due to technical reasons and we would be updated in one hour.
I'm not sure why it was described as technical reasons as we could actually see the plane and you could see an ambulance and the co-pilot being removed from the plane in a wheelchair with oxygen and being taken away to hospital.
Anyway after an hour the captain came to the gate and told us that the co-pilot had fallen ill on arrival and that they were flying a pilot in from London and that we would be leaving at midnight Cyprus time (a 7 hour delay)
I found it a bit of a coincidence that he had fallen ill on arrival and the gate change a few hours earlier (they had moved us to a gate where there was less flights arranged so less people) but obviously we can't prove that it didn't happen on arrival.
I understand that it was an extraordinary circumstance but feel the co-operation could have been a bit better and since we were due back into the UK at 8pm and arrived in at 3am a lot of people had to take an extra day off work, so I was just wondering if something like this had a case for a claim?
Thanks0 -
But is it an EC? The co-pilot was ill and needed replacement. Crew sickness happens (carted off in wheelchair/oxygen is irrelevent) and is an inherrent part of an airines operations. Get youor claim in.If you're new. read The FAQ and Vauban's Guide
