  • Well after my lovely news last week that my claim was been paid imagine my pleasure when I found a cheque at home today for Thomsons.

    This pleasure is however short lived as despite the fact I put the claim in, I have written the letters, done the phone calls and claimed for myself on the form they have sent the letter and cheque to my ex-boyfriend who was the other passenger on the flight.

    I now have a cheque I can't cash and another phone call to Thomsons to try and resolve this issue. Based on my previous experiences dealing with them I assume this will be a painful and long one... Any advice?

  • I used the template letter provided by MSE for a 6hr delay from Mahon to Manchester on 20/09/2014. I believe the delay was due to the plane needing a new tyre. I sent the letter on 19/05/2015 to ‘After Travel Customer Support, Thomson Holidays, Wigmore House, Wigmore Lane, Luton, LU2 9TN’ and I requested €400 per passenger, therefore a total of €800, in compensation. I included my email booking confirmation.
    I submitted the same letter and information again on 02/06/2015 through Resolver (found through MSE).
    I was surprised and very happy to come home yesterday (17/07/2015) to a cheque for £569.16 (€800 @ 1.4055 exchange rate). :-)


    The letter states "After investigating your claim for compensation, I can see from our internal airline reports that your flight was affected by a delay as a result of operational issues."

    Hi, newbie here, read all the posts with interest!
    I've started a claim with Thomson for a delay to TOM183 on 11 Jan 2015 Cancun to Manchester, 13 hours delay. Had the stock knock back, and about to write again refuting their position. I naively thought this would be a straightforward exercise with a rapid payout, silly me!
    Wondering first of all if anyone on here was on the same flight?
    Also, read with interest post #6251 from olispence about a flight Barbados to MAN a couple of days earlier (9 Jan), diverted to Azores due to medical emergency, which was the reason behind the delay to our flight (given by our holiday rep and confirmed by a family member who is Thomson crew). Is this a coincidence or is it the one that affected our flight I wonder?
    As our delay was a knock on from an earlier flight, it's not clear from posts I've seen on this forum whether we have a valid claim - I gather it helps to have as much time separation between the affected flight and our flight as possible. So it might help to confirm the diverted flight details, any advice how I could do that as it’s not very clear on Flight Stats?

    I have started proceedings against Thomson for a delayed flight in 2009 and they are defending the claim.
    Could someone help me with the following? Their defence is as follows:
    "As a preliminary point, it is denied that the Claimant has any right or standing (locus) to bring any claim in respect of costs, comepnsation or other relief as allaged or at all on behalf of another person, be it a family member or another. It si therefore averred that the claimant is required to apply to the court for further claimants to be offed ( with their full names and addresses given); failing this, the claim purported to be brought by the unidntified claimants should be struck out.
    The calimant failed to particularise their claim. The claimant should be compelled to provide the follwoing information:a Booking reference b Names of Claimants c Flight number.
    The defendant reserves the right to amend the defence subject to receipt of the afore mentioned."

    How to I get the court to add the other names? I did include them in my orignal statement but without addresses and I have included the flight number but dont have a Booking Reference.

    MCOL or N1 form application? Have you/did you read Vauban's Guide?

    MCOL is intended for one person, some people have got that changed via the court. Maybe somebody will advise you how.

    " Money Claim Online - MCOL for single claimants or the paper form N1"



    So you need to 'phone the Court in the first place (assume your case has been allocated) and ask the clerk if you can add additional claimants and go from there. Obviously pointless providing addresses/booking confirmations etc if the Court will not permit changes.
