Thomson haven't "screwed you". I'm afraid that it sounds as if you have got this wrong but it depends on exactly what you did. You can have more than one claimant to an action but each must be separately named. You can't make a claim on behalf of yourself and other people. As you say your husband is out of time now. However, there may be some salvation for you by applying to the Court to add your husband as a Claimant to your action. This is by no means simple because of the expired limitation period and you might do better to take your own compensation and put it down to experience.0

If your 6 years expires 30th June then get another, seperate claim into the court. If they want to play silly buggars, let them. It should present no problem as they have already admitted liability! Presumably you have already sent an NBA for both of you.If you're new. read The FAQ and Vauban's Guide

Hi there, I've been speaking to Thompson since 2012, and have provided everything they have asked for, waited for the court cases to conclude, until finally, in January I resubmitted the request. Throughout I have had appalling service, rude emails, no contact, been fibbed to, and the latest is that the booking docs I sent in attachment were too small.. They were direct scans of a4.. They have asked for boarding cards, booking forms, luckily my friend is obsessed and keeps everything, I even sent the in flight menu to them!
Awful company, never respond, never release documents, I would never knowingly book with them as their after travel care is appalling.
It's now a matter of principal.. After 3 years! I travelled in 2010!0 -
Sorry. I missed the 30th June date. That will teach me to read things properly. Yes issue another claim pronto. If they complain about having to pay two sets of court fees, that's entirely their own fault. In a way they've done you a favour by tipping you off before the limitation period has ended.0

Menousha, you have been given the run around just the same as everyone else on here (most of us joined because we had our own claims). Read Vauban's excellent guide and then send them a notice before action. Give them a fixed date to respond and if no joy, sue them!
As to future travel, Thomson are no worse than most budget airlines so if you find the right holiday or flight, I wouldn't stop using them.0 -
I'm just about to issue my claim - for me and my husband. I've not done it online as there's two of us and I've drafted it with me as the First Claimant and my husband as the Second Claimant. I work at a law firm, in the litigation department, so had help drafting the Claim Form and the Particulars, and on some of the lawyer's advice, even sent draft Particulars to Thomson giving them a week to reply/settle. True to form, they didn't bother replying. I can't believe they are able to get away with such poor customer service.
I think I've got a strong case - 3 separate delays, first one bird strike (which as we know was accepted as not an exceptional circumstance recently) but not only that Thomson put in their only ever letter to me that the plane was damaged on a previous rotation, a CAA FOIA request stated that the plane was damaged 3-4 days previously and kept in use - so not even my flight that suffered bird strike, the replacement plane sent to us suffered a technical fault - Thomson ignored my letter asking what that fault was and then the crew were out of hours! Delayed by 9 hours. So we'll see what happens !0 -
Hi gang - I'm working on my bundle & particulars of claim ahead of a Monday deadline and a court date vs Thomson at the end of August.
Has anyone faced Thomson in court recently and how did it go? Or did they settle the night before?0 -
They settled my case at Court as I was lucky enough to have it heard a few days after the first appeal in Huzar. If Thomson think they have a sound defence, they'll defend. If they don't they will settle. Make sure that you get your documents in on time0

Hi all - had recent correspondence from Bott and co stating that Thompson are finally coughing up the money for our case (3 x 400 euro's less costs from bott and co)- almost 6 years after the delay happened! Well happy!0
