If Thomson's planes had that many "hidden manufacturing defects" even the toothless CAA might have something to say AND do about it.
It might be worth writing to CAA sending a copy of your letter pointing out that you believe that this is a another delaying tactic/misinformation by Thomson.
Mention that you are aware that this "excuse" is being peddled by Thomson on a regular, probably daily, basis and perhaps CAA might like to investigate?If you're new. read The FAQ and Vauban's Guide

Not just "pushing your luck". You'd lose and lose your court fee. There is no right to interest in these claims unless court proceedings are actually issued.As for the exchange rate, You are owed a euro amount, nothing is mentioned about an exhange rate, they could pay you in euros and you couldnt really argue0 -
TOM258 Birmingham to Punta Cana 23/03/11 Flight delayed by over 17hrs. Thomson have paid out at last, cheque arrived today! Anyone else trying to get compensation for this delay, carry on fighting it has taken us over 3 years but we won in the end. Thanks to everyone who has posted advice on this forum, it has been invaluable. Good luck to everyone else still fighting.:j:T:rotfl:0

That's the whole issue! Court proceedings WERE issued but the judge decided, against our express wishes to have an oral hearing, to go ahead and make a paperwork only decision! We were prevented from showing our proof regarding the inaccuracies in the Thomson defence.
We would not be "pushing our luck" as we weren't allowed to have our hearing even though we had paid for one!
Now that Thomson have received another NBA letter from us they have informed us that they will be paying our compensation claim! We did point out in our letter, the incorrect information that they had submitted in their Disclosure which might have helped!
I spoke to the Manager last week and he told me that Thomson will be paying 4% interest. Also court costs! So even though the judge made the wrong decision, Thomson after reading our submission of proof, in our recent letter, have agreed they were at fault!0 -

You have just confirmed what another poster said earlier. I have now typed the NBA letter and it will be heading their way tomorrow- signed for of course!
I have just read your post regarding sending a letter to the CAA, to make them aware of the alleged Thomsons delaying tactics and this will be my next job. There seems to be so many technical faults on these aircraft, it makes you wonder how they get from a-b. Thank again for your invaluable help. Sally0 -

As I said before, Thomson know we have the proof and they know that the judge was wrong in making that paperwork only decision on our claim.
They also know that it would cost them a lot more to go to court and pay for a barrister to attend. So they will indirectly save money to pay our claim now before we resubmit it again.0
