    Thank you for your comments.
As previously mentioned, I won't be able to see the letter until tomorrow when the visit.
It was a long day with lots of things happening.
Briefly, Boarding took place as if everything was normal. Plane taxied down the runway and returned to base. They were locked inside for 1 1/2 hours. Some passengers were starting to loose their cool. Evenutally they were dis-embarked and taken to a hotel and given a voucher. Collected late evening and arrived in Newcastle some 9 and a bit hours later. Reason
broken part, no parts available in Spain, part and engineer flown from UK to fix. I think the letter says something about manufacturing fault but will know more tomorrow. By the way, I have read Vauben's guide and do think they have a valid claim.
Does anyone know what Bott & Co's charges are please should they eventually get Thomson's to pay up please.

Slam dunk valid claim IMO if that helps Sally ;)

I think Botts fees are 27% on a no win no fee basis.

Will have a look through the guide and post back if any further queries.

    Thanks for the help.

Have now read Mark2sparks guide Novice. I'm going to write back to Thomson and tell them to rethink as the weather did not affect our flight but a previous one and they need to compensate us. Fingers crossed!

Make sure that any further correspondence now includes the 14 days notice before action wording (NBA) Angie.
You're probably going to have to take them to court.

Hi Mark2spark, our delay was about 5 hours from Sofia to BHX, no the tech fault wasn't on our flight but on a previous one, so in essence the tech fault and bad weather were both problems affecting the previous flights, we were simply the victims of a knock on, leading to a hellish few hours in the middle of the night in a closed Sofia airport....was grim to say the least. That's why I'm drafting a letter right now throwing their 'exceptional circumstances' back at them....and giving them 14 days...bring it on Thomson, I wont be fobbed off!
  • Actually I have been reading more posts this afternoon and there seems to be more success when CAA are informed. I am wondering whether to complain to the Spanish CAA equivalent now Thomson have fobbed me off (the delayed flight was leaving Tenerife so our own CAA wont get involved as the departure airport wasn't in the UK) and seeing where that gets me? Any thoughts?

I doubt there is a single regular contributor here who would suggest going down the CAA/AESA(Spanish CAA) route.

It's time consuming and even if they agree with you they, have no teeth, you would still have to go to court if the airline refuses to pay.

With the help you have here I would suggest you DIY. That way you eventually get that glowing feeling when YOU win.

    Good luck, whatever your decision.

Thanks - as I suspected really but I would like to be able to check and pull them up on, their assertion that there were air traffic control restrictions at Exeter, as I suspect they are fibbing!

Have no problem DIY Court proceedings but there were 8 of us in our party in total- does that mean 8 separate Court proceedings (& fees) per person? Or can I do it under 1 Court form? I have the confirmation details of the names of the passengers as kept our booking details.

I am really hacked off that Thomson have been so dismissive, although not surprised to be honest.
Checking flightstats, it would appear Mrs O, that there were only a couple of small delays, < 1 hour at Exeter on 27/28 Dec 2014.

  • Hi all,

I've been chasing Thomson now since Sept. 2013 for a flight delay of 20+ hours in Sept.2011. Got the 2 year nonsense letter at first, then the "waiting for the CoA and SC decisions" and to contact them again, which I did. Automated responses as expected.

I lost interest in December when I suffered an injury and couldn't be bothered with the NBA I'd planned on sending them. Then as a last resort I decided to see what Resolver was all about.

I raised the issue with them on 28th Jan, this was escalated to the Customer Services Manager on 11th Feb, and the next escalation on 3rd March to the Chief Executive Officer.

Today, to my absolute surprise, a cheque arrived from Thomson for £600.87p (the equivalent of €800). :j. The letter is dated 18th Feb, just three weeks since I first contacted Resolver, but only posted yesterday. I still can't believe it though. I was getting nowhere and had more or less given up, which is what I'm pretty sure the airlines are hoping for.

So I'm happy today, I know it's only a small victory, but still a victory nonetheless. Celebrations tonight :j
