Flight delay and cancellation compensation, Tui/Thomson ONLY
Comments

Following my earlier post about compensation for this flight delay (25 hours) and the couple we were travelling with receiving a cheque, I wrote to Thompsons saying we should also be entitled - I'd written to them twice in March and May 2012 with no positive outcome but had not chased since, left that to our bolshie travelling companions! So, wrote on 12th Feb, letter and cheque arrived (dated 24 Feb!) this morning, £901.32 equivalent to 600Euro per person!!
Interesting paragraph in their covering letter that others may wish to use :
"After investigating your claim for compensation, I can see from our internal airline reports that your flights were affected by a delay as a result of operational issues".

I phoned Thomson this morning to check some figures with them before I receive the compensation payout as promised by them last week. The nice man was on leave until Wednesday so I spoke to Amy in the Flight Delay team. (another nice person)!
We have already received a cheque for £901.32 and I explained that we had been delayed 24 hrs outbound and 24 hours inbound. The lady checked and told me that she would phone back. As I had a hospital appointment today I asked for an e-mail to be sent with the breakdown of the compensation. She agreed.
I wished to remind her that interest at 8% was also due and I would send the GOV.UK notice to her which says that interest rates is usually 8%! Although I had been told last week that the interest paid by Thomson would be at 4% only. She then informed that it had been decided that as from last week ALL claims would NOT have interest added!
I then queried the euro exchange rate would be that on the date of the delay? In our case the euro was 1.1759 at date of delay. I was then told that the euro exchange rate was as from last week! So this means less compensation. The euro is going up now! Shame! Are they correct in not paying the euro rate at the time of delay?
On checking my emails I saw that Amy had replied after our chat and said that she needs to speak with the Manager who is back on Wednesday. Also there is no need to email my proof of figures!
So we are nearly there now? I will obviously let you all know later!0 -
Glad you got some cash, my own claim is going through the court system after letters dating back to Christmas 2011! Not paying interest is a new one on me. As far as the Euro exchange is concerned, I suspect they are waiting for the Eurozone to collapse so they can pay in Russian Roubels. Shame about MCO website being down for a week, Thomson have until Saturday to file a defence to my claim, after delaying the first 14 day deadline to 28. Best of luck.0

I have also spoken to the flight delay team this pm, i submitted my claim on 17th Dec 25 h delay from Punta Cana on the 15th Dec 2014.She could tell me the COMMITTEE next meets on the 9th March and my claim will b decided then, we will hear by the end of March!
When we landed at Manchester we were handed a letter stating the nature of the Technical fault and the exact delay time, we knew all the facts about the fault, wondering if any one else on other flights that were delayed ever got a similar letter.0 -

They dont have to pay interest unless a judge orders them to, and if they are paying up without going to court you would be pushing your luck to take them to court for just the interest part of a claim
As for the exchange rate, You are owed a euro amount, nothing is mentioned about an exhange rate, they could pay you in euros and you couldnt really argue0 -
I have just recieved a 3rd rejection leter from Thomson stating that a hidden manufacturing fault a spoiler sensor caused our delay and are still stating extrordinary circumstances is this a new delaying tactic or does it carry some merit as i am now ready to make a claim through small claims?.0

Time to issue NBA and thereafter to commence court action. All info in Vauban's guide - enjoy the 'ride' and your compensation.0 -
We were delayed in May 2011 for 25 hours to Mexico, 7 hours in Birmingham then due to a technical fault we had to land in Manchester and spend the night there. We have been writing to Thomson for some time and have sent 4 letters to them and have been rejected 3 times. After last weeks judgement My husband and I were just discussing whether to put it in the hands of a claims company or to try again when this morning I received a cheque for £901.32. Very please to get the compensation and to have done it at nil cost, if a little stunned that they finally have agreed it with no further arguements!!0
