    Regarding Flight TOM773 returning from Sharm El Sheik on 13.06.14 (30 Hour Delay)

    Sent a letter to Thomson asking for compensation, received a fob off letter back about 2 weeks after. Sent another letter, got another fob off letter. Couldn't be arsed with the back and forth so gave the claim over to Bott & Co in August, received an email today to confirm that Thomson will be paying compensation in full, I believe its around £1000. B&C take 30%, me and my girlfriend are left with 70% for almost no work at all. Well worth it!!

    They have informed the court of agreement to settle but the court have said they have nothing. Difficult one really. I just don't trust them anymore. I am running out of time to claim my hearing fee back as Thomson will not pay this. I guess the court will award it anyway.

    After a letter to Thomson in October using compensation template for flight delay on TOM 029 on 16 Sep 14 - no response.
    A second letter in November referring to the first letter and the fact that I had it signed for on delivery and keeping an audit trail - no response.
    A polite email to the complaints department in December referring to the 2 letters and the audit trail, S Smith signing for letter, boarding pass stubs, holiday reference, baggage labels and the fact that 63 days had passed since my initial correspondence.:rotfl:
    Letter from Thomsons dated 19 Dec arrived 2nd week in Jan with an apology for 7 hr delay from Cancun and a cheque for £954.
    So, many thanks MSE, it was worth the 2 letters and a polite email.

  • Yesterday my wife got a cheque for £932 from Thomson Holidas. It has taken 2 years and about 10 letters in total. We were delayed 24 hours coming back from Mexico. We are using the money to book anoter holiday with Thomsons!

    Well having previously deciding to give up my fight for a delay due to weather on a previous flight and having tried numerous emails and several phone conversations where they say they won't pay I have today issued an MCOL, so let's see.

    Thomson were given until 29th Dec to state why their defence should not be struck out. I did not hear a thing so I waited until the 2nd Jan and then wrote to Thomson and the court. I also requested payment of 1 days pay and travel costs as I attended the hearing.


    Today in the post I received from the court Judgment for the Claimant for debt plus interest and court costs, :T but no expenses as above. I'm not greedy and will accept what the courts have stated but can Thomson try and knock this figure down? Can I expect that I will now get a cheque for the amount stated by the Court?

    congrats and well done,

    Easy answer NO what you have been awarded cannot be amended it is an order of the Court, so you should receive the full amount via Cheque or Bank transfer.

    Just my tuppence worth of a medical emergency being an EC...
    Although the end result would be the same, IMO an 'in flight' medical emergency might well be classed as an 'in flight safety issue', one of the cited reasons for not paying up in the text of the Regulation EU261.
    But as it didn't happen on *your* flight, it's not a valid defence.
