I'm wondering if any one else is claiming for the 25 hr delay we had on this flt, I emailed Thomson on the 17th Dec, got the automated reply, I recieved a 2 line letter dated the 19th Jan saying they were looking into my complaint, so I am hoping that after 56 days they will pay out as this was a technical fault. We also paid for seating which on the return leg we were given different seats , I asked for my money back which I am pleased to say they paid without any hassle.0

I am pleased to say that we received a cheque for our delay in October 2013 at the end of last week.
We were travelling from Gatwick to Cancun and delayed by 10 hours for technical reasons. We waited the outcome of the stayed cases, and saw that someone else on this board had been paid out so then sent the initial email to them.
To give Thomson Airways credit, we received the cheque about 5 weeks after the email was sent, so for us it was all plain (or should that be plane?) sailing.
I wish everyone else luck with their pursuit of their compensation.0 -
I put in a claim to Thomsons for a delayed flight. They gave me all sorts of waffle and excuses. The next part of the process listed on this site was to then write to the country where the flight started from. It was a bit of a blow it wasn't the UK but I wrote with all the details to the Dept of Civil Aviation in Cyprus at the address stated. I received no reply. So what do I do next?0

I sent a NBA to Thomson in early December. They replied last week saying they now need boarding passes or booking conf. How come they ask for this now, rather than in reply to 5 previous letters...
So I am now filling in the N1- just need to check the value of the amounts claimed with more experienced board users if that is ok?
In the value box I have given the compensation amount as £437.27 and interest thereon as £170.87.
Do I also need to details costs incurred so far, like printing and postage, to get the right claim amount to put in the little box in the bottom right where you add on the court fee to get the total cost of the claim?0 -

You MAY be able to claim more than this if the Judge can be persuaded to make an order under CPR 27.14 (2) (g) (Unreasonable conduct) This might be the case if you turn up and Thomson don't especially if they haven't told you that they no longer contest the case. Remember to ask the Judge to make such an order if the circumstances arise.

Thanks for your advice. I have already included a £90.00 appearance fee in the costs for the first hearing and another for the upcoming hearing. I will keep the CPR 27.14 (2) (g) in mind as i have tried at no end to resolve this. I have express my willingness not to return to court in my letter to the judge, its such a waste of time and i dont want the judge to think it me trying to extract higher interest etc. I really can't understand way it has come to this and there has been countless settlements on here over the last few months.
There should be a way to claim emitional costs as the first 3 hour hearing is definatley something i never want to repeat again. Also this time i have to arrange for my children to go to the afterschool care as pickup time clashes wth the hearing. All this stress and they may not even show up!0 -
My first ever post. Thomson flight TOM050 London Gatwick to Sanford Florida 6th May 2011. Four passengers. Have checked online and can claim the 600 euros per person for the delay. First wrote to Thomson in 2013. Letters sent back and forth and their last letter sent to us was in August of last year saying to wait for the Supreme Court's decision and to then contact them. Wrote in November and this January. Both letters received as were sent signed for. Have rung Thomson various times and always get through to the call centre in Swansea. Got told they aim to respond in 56 days and that would be from the letter sent to them in the November. Then was told it was 56 working days. It is now 70 odd working days. Last time I rang which was last week, I got told that they have been inundated with claims at the Luton office and have taken on extra staff there to cope. I was told that someone has clearly been assigned to my case as the amount of days are showing on the system. They told me that they have no idea when I will hear from Thomson and to ring again in a month. I was also told that even they can't ring the flight delay compensation team and can only email them.
We have legal cover through our home insurance and they say that we do have a case and will act for us.
Do you think we should give Thomson a bit longer or go down the legal route with our insurance or even go down the legal route ourselves with the small claims court? I really just don't know what to do.
I would be really grateful for any help and advice. Thank you very much.0 -

It's really up to you - personally I think you've been more than patient, and it's clear they're not really prioritising your case. (I imagine they are focussing on settling those who have taken legal action.)
If you're not sure about what to do next, my guide is a good place to start.0 -
NWSteve the interest ( at the top half of the form ) you put on the form is per day if you read it, and then you add the total interest into the amount claimed. Well that's what I did.0

Vauban, thank you very much for your quick reply. We are definitely going to take it down the legal route, but don't know whether it's better to do it ourselves through the small claims court or through the legal team on our home insurance.0
