    Summer, of your 3 options
    1. Doing it yourself is cheapest and you keep all your damages if you win but has the most hassle and least chance of success.
    2. Going to a NWNF firm who specialise in this area is the easiest option. They will do all the work for you but you may them a fee and possibly a percentage of your winnings.
    3. I would be very wary about using a solicitor nominated by your home insurance company. They have to be on a panel and very few litigation solicitors have detailed knowledge of these regulations. Until I started on this forum and had my own case I knew virtually nothing. Most of what I've learnt over the years has come from the experts here, especially Vauban.

  • Just thought I'd let you know that Thomson have (finally) paid me my compensation. Initial claim was absolutely ages ago - got knocked back due to 'exceptional circumstances'. Our plane was delayed incoming due to a warning light, and we were delayed for about 5.5 hours in Rhodes while a new part and an engineer were flown out. Eventually we were allocated a different plane.

    Anyway, I just let the matter go for ages, but wrote them a simple letter after the recent court cases asking them to reopen the case. This was in November. Received a cheque from them this week. :T

    As I (and others) have said, Thomson have made a business decision to settle the vast majority of outstanding claims which had been stayed pending the Supreme Court's decision in Huzar and Dawson. It is taking a while to clear the backlog and they seem to be concentrating on existing court cases first.

    Sadly, this approach is not taken by all airlines.

    So, if you have submitted a valid claim to Thomsons keep on with it.
  • I received my letter from Thomson rejecting my claim for flight delay to TOM1526 Belfast Intl to Corfu on the 25/07/14. They quoted the reason being Lighting strike under article 7 of EC 261/2004 if you look at article 7 it refers to Security-Hi -Jacking, this is just a case of fobbing the customer off, how would I go about getting the true reason for this delay, Is not the plane designed to fly even if struck by lighting? This was in the Summer no bad weather about.
  • I'm no expert but having read a lot of the post if they have said it was caused by lightening which equates to the weather then they are unlikely to pay out, getting money from these airlines is time consuming and there doesn't seem to be any pattern as who and when they pay out.

    Actually Article 7 talks about neither of these things.

    What were the circumstances around your delay - were your delayed in the air, or did your plane not turn up? If you were struck by lightening, the airline would likely have a case. If however the strike occurred before your flight, they likely wouldn't.

  • Do you know whether you have to be the lead passenger to claim from Thomson. My son and his girlfriend went on holiday a year ago and were delayed. The girlfriend was the lead passenger. My son claimed for compensation but the case has dragged on and unfortunately my son and his girlfriend have since split up. Thomson are now saying that they can only deal with the lead passenger. Is this true?
