could somebody please help me... i need to fill out paperwork for the small claims court and i remember reading somewhere that there are different names for thomson when filling out this paperwork. i booked through a thomson shop for a all inclusive holiday. so would i put the name down for the defendant as thomson, or thomson airways or thomson holidays or is there a different name? thank you0

Assuming you flew with Thomson (not just booked with them) then the Defendant is "Thomson Airways Ltd".0

thank you. yes i did fly with thomson aswell as taking out there all inclusive package.
before i send off paper work to small claims court do i need to notify thomson i am doing this? is there anything i have to do before sending paper work or do i just send it off and cross my fingers?0 -

I think sending off the paperwork without any real idea of what you are doing is probably a recipe for disaster. Go in to this with your eyes open, having done your research first, is my advice.
My guide - the last link in the sticky on the main forum page - should more of less cover the bases.0 -
ok thank you i have read numerous posts on this website and i have done some research into delay times and amount x by amount of people im claiming for. do you have a link to the post your referring too?
also you said before i need to put tye name down as thomson airways ltd.... somewhere i read somebody was saying they put down Tui? just want to clerify that thomson airways ltd is correct as i read if you have the name incorrect you have to restart the whole process even though there the same company... thank you again for your replies0 -

If you are making a claim under the Regulations, the correct Defendant is Thomson Airways Ltd. It would only be correct to sue Thomson holidays or some other name if you were making a claim about a package holiday.
It is not fatal to get the name wrong as the Court will usually allow you to correct it but you might as well get it right.

Hi Markylou & David-e
I was also on tom175 on 28/7/14 from cancun to manchester. I wrote to claim compensation & have received the standard ' bad weather' response.
However the manchester / cancun flight arrived on time & someone in Thomson made a conscious decision to delay the returning manchester passengers. This is not due to exceptional circumstances as it could have been easily avoided by not redeploying our original aircraft . Therefore I am writing a further letter & hope you will too. If no joy I will refer it to the CAA. Please let me know if you are still pursuing this.

Good luck with your claim. But the airline will likely ignore your letter, and the CAA will wring its hands and say it can't make the airline pay, unfortunately ...0 -
Our flight to Cancun was delayed for 6 hours LGW-CUN on 26/08/14 TOM28. We received a text message less than 24 hours from departure to inform us of this. On checking the Thomson website it looked like a flight a few days earlier caused a backlog inc our flight.
Does anyone think we have a chance of claiming anything back ? I have already sent the the email with the letter from MSE.
I am sure I read somewhere that if an earlier flight caused a backlog and resulted in further flight delays the onus was on the airline operations to rectify this and if they didn't then a passenger is entitled to compensation ????0 -
