Hi , i was on this flight tom122 26 august 2014 and have got to say it was a total disaster for me and my daughter, firstly got a text message the day before to say there was a delay 10 55 to 18.50 ,messed up our taxi has had another booking ,we had payed to book our window seats, so when we get to the bag drop , the girl told us she would give us good seats , so thought not to bad ,when the gate opens everyone is waiting to board, announcement due to cleaning boarding will be in 30 mins , then 20 mins, then 15 mins , then 30 mins . then announcement there is a luggage container stuck in the hold, then firemen where called . by this time absolute chaos, then the police called .finally boarded about 8 o'clock , goes to my our seats row 12 , window seats , absolutely no window ,just a white wall , absolutely fuming at this time , so nearly 10 hour delay for me holiday ruined .0

I have read through the faq's etc and think i have a chance of a claim.
Our flight Tom314 from LGW to Sharm on 06/08/14 was delayed by over 4 hours. Was due to take off at 0925 hrs but left nearer 1400 hrs. Got a text message the night before re the new flight time of 1325 hrs does this make a difference to being able to claim ?
The reason for the delay was the dreamliner we were meant to fly on had a problem on a previous route and was diverted to the Azores. We ended up on a 767 replacement plane. So from what i have read am i right in thinking as the fault was not on our flight the delay is more due to an operational issue of getting a replacement plane ?
Any opinions on the above ?
No surprises on this one. I was on TOM314 on the 10/09/14 just over a month later and guess what, we had a 5 and a 1/2 hour delay. Eventually arriving in Sharm at 22:00. I'm currently putting together my case for a claim. Did you get anything back from Thomson?0 -

Just preparing my letter to send off from the template and the very good advice listed on this site! I was delayed on the 10th of Sept flying with Thomson from Gatwick to Sharm. Historically this flight has an appalling on-time rating. We ended up with a 5 hour and 51 min delay eventually departing at 3.16pm instead of the original 9.25am. I have just spoken to Thomson who have advised me to either email or post it. I plan to do both with the letter being tracked so I know they've got it. I was just wondering which legal cases to quote in the letter to the airline if needed? I know there are a few floating around but as I am inside the 6 years and under 24 hours which ones are key?

Simple ... you are making a claim in respect of regulation 261/2004 for a delay in excess of 3 hours. No need to track letter ... proof of posting from PO sufficient.0 -
Hi There I was delayed with this flight on the 16/09/14 AT Palma airport.It should have departed at 11.45 but finally took off at 20.40.I am seeking compensation for this delay and the poor information from Thomson and their handling agents Iberian airways,what are the chances of success anybody else claiming.0

Please also don't start you own thread for a specific flight.
And - to answer your question - no one will have any idea of your chances of compensation. It depends on a) the circumstances of your delay and b) how well you pursue your claim.

I have been trying now for over 12 months to claim compensation from Thomson for a delayed flight from Menorca to Manchester back in October 2011. We were delayed by just over 3 hours. Initially they turned by claim down due to the technical fault not meeting the criteria for compensation, however our flight was held up by two seperate delays, one in bound and one out bound, so I have written back to Thomson asking them to advise the full circumstances of each delay and what exactly the technical fault was. I wrote in April with this enquiry and received no reply or acknowledgement. I then re-sent my letter again in July and still have heard nothing. Is this normal - are they ignoring me hoping I will go away or does it take this long to hear anything ? Any advice would be appreciated as to what I should do next - do I telephone or pass it on to a higher level and if so to whom ? Thanks in advance.0

NBA then court either by yourself or through a NWNF. All covered in Vauban's great guide in the FAQs
You may also want to read up on the Huzar appeal (there is a thread explaining all this)0 -

If you have enough proof to show that the said flight was actually delayed And not because of technical fault (Extraordinary Circumstance), then you must proceed court action. Or contact any No Win No Fees Firm Who could help you.0 -

You need to read up about the Huzar case. There is no law currently that says a technical fault is an extraordinary circumstance
Compensation is applicable if the delay is within the airlines control so if bad weather or ATC then this is extraordinary. The Huzar case is about technical delays and the fact that keeping aircraft in serviceable condition is the responsibility of the airline
