    Vauban I owe great thanks to you for sharing your bundle (in the dropbox) which I relied on heavily in the preparation of my own bundle. These claims are all about the previous cases in higher courts.

    Yes, I'm sure their Counsel and our costs will soon add up to more than we're claiming.

    The process has been far more time consuming than I ever envisioned, but hey, now I've been to court, and it was the full Monty (not just a small office which I was expecting).

    Thanks to everyone here who has described their day in Court, your experiences were invaluable. I would have been totally phased by the Stay application if I hadn't followed this forum so closely since last December.

    Jerry, lets hope for a good outcome in Huzar so you can return to court (or possibly even not have to) and show these airlines up for the inconsiderate shower that they are.

    you have written earlier in this post that your flight was delayed not because of technical fault but crew out of hours. so why should you join huzar vs jet2.com case as it is a technical fault case. If the airlines not accepting that the flight was delayed because of crew and you don't have evidence to show then ask to CAA to find out the reason behind the delay for the said airlines.

    The general recommendation of this forum is NOT to involve the CAA. They are bound to side with the airlines (who pay their wages) and if they find in favour of the airline the Judge may possibly accept their view - the CAA seldom find in favour of the claimant and if they do the combined airline/barrister approach to a Judge will lead him/her to readily accept the CAA have no jurisdiction over a UK court.

    I have all the evidence surrounding the delay from the Defence bundle.
    I used this evidence to attempt to prevent the Stay.

    However, because the Defence claimed Extraordinary Circumstances arising from the technical defect the District Judge said they must allow the Stay. This has happened in other cases too. If I hadn't known this has happened at other courts I would have agreed with you.

    On the bright side if the Huzar appeal fails then we win.

  • im still waiting on the 2 year ruling circus. It has been nearly two years since I kicked my claim off.
  • Hi,
    Haven't heard back from Thomson yet regarding our 9.5 hour delay to Mexico from Gatwick in September 2014.
    How are people proving they were on the flight when thomson are asking for boarding passes? We didn't keep ours, is there any other way I can prove it, or is it up to them to prove I didn't get on the flight I booked and paid for?

  • I just sincerely hope the Supreme Court in November will tell thomson they have no leave to appeal the appeal they are wanting to appeal and that they need to pay all their customers forthwith including interest.
