I made reference to the Jet2 Vs Huzar in my claim, they have just paid up in full. The delay took over 30 hours as there was a hydraulic fault on the dreamliner
The claim did take around 3 months to process though0 -

Haven't heard back from Thomson yet regarding our 9.5 hour delay to Mexico from Gatwick in September 2014.
How are people proving they were on the flight when thomson are asking for boarding passes? We didn't keep ours, is there any other way I can prove it, or is it up to them to prove I didn't get on the flight I booked and paid for?

I have commented several times about 'proof' of being on a flight.

I have sent two letters to Thomson regarding my 17hr+ delayed flight
and whilst I have received a response on 2 occasions they now look to be 'hiding' behind the outcome of the Huzar Vs Jet2 case
Whats annoying is that they are stating that the nature of the aircraft's issue was 'spoiler messages and other defects on the aircraft that require necessary assessments and repairs etc This was outside their control and therefore classed as extraordinary circumstances' BUT in the next sentence mention the supreme court and Huzar Vs Jet2 and to contact them one the supreme court it's made its decision???

I flew with Thomson Tom742 (Dreamliner) this was flying from Glasgow to Sanford Orlando and was scheduled to fly out on the 25th of July 2014, but was delayed 24hrs.
I sent the template letter provided on here to them just over a month ago, but I haven't had any acknowledgement from thomson as of yet.
Any ideas what I should do now?

I posed off a claim to Thomson in August after my flight from Palma was delayed for 3 hours 50 minutes. At the airport there was a notice that said the delay was caused by roadworks around manchester airport namely M56. I put this is my complaint but Thomson rejected it as it was beyond their control, stating that passengers and staff were late due to traffic problems around M56. I have checked news articles from August and it is clear that the road works were well publicised, starting with the vice chancellors report in 2011, I have posted back a notice before action as I believe that reasonable measures could have been taken to ensure that aircrafts were properly staffed? Does anyone have any advice, am I within rights to claim.

Hi I just returned from Dalaman on 10th October 2014 and experienced a 16 hr 25min delay. The pilot told us this was due to some kind of hydraulic failure. They had to fly someone over from Luton to fix it.

This sounds similar to the fault we had - what exactly did you say about the Huzar case? I haven't sent my initial letter to them yet - have just been gathering as much info as I can before I send it, and was going to ask if it was worth mentioning it as I know the case is to be heard in Supreme court soon. Any pointers would be great.
I have used the template letter. There were 5 in my party (should have been 6 but 1 person didn't travel) so a decent amount if we are successful (I am expecting court and a long process!)0
