Initially it was a faulty plane, and then the next plane sent was also faulty, or something along those lines. We had a 28 hour delay and we were on a 7 day holiday. We did complain and ask for compensation at the time, especially as we were meant to be on an all inclusive holiday and had to pay for drinks at the hotel were we were put up overnight, but we're told " no chance" I do wonder if they still had that letter on file somewhere, which is why they paid up with no more questions!0 -
Shortly after returning we wrote to them regarding the delay, they didn't want to know. 12 months later we sent them a NBA, still no joy. We are now letting Bott handle the cas. Our question is, will if the SC rule in their favour that even though we sent them a NBA in 2012 say no it's over the 2 years. We have still got all the correspondence we received from them.

Writing an NBA does not "stop the clock" - only serving legal papers via starting a court claim does that.0

Good afternoon everyone,
I am after a bit of advice if any is on offer.
My case against Thomson was listed for May and I arrived at Court to be told by the Thomson rep that they were going to request a stay pending Court of Appeal cases. Wasted day all round. Instructions from the Judge told Thomson to inform the court of the outcome of COA cases in July. I then received a letter in July stating the case had been further stayed until November pending outcome of Supreme Court decision.
I have not been home to check the post, but I have received an email from Thomson today, “As you may be aware, the matter has been listed for a telephone hearing at 2pm on the 4th November” and asking me for a contact number. Surely this will be a waste of time if the Judge previously decided to stay the case for the Supreme Court decision. I appear to have no say in this whole process. I don’t know who allocated the telephone hearing or why it is going ahead at this point. Does this mean the Judge has run out of patience and wants to clear the case?

I suggest that you check with the Court yourself rather than relying on Thomson. If the telephone hearing is going ahead you must be involved otherwise you may end up with a decision made in your absence. I suspect that the case will be stayed again but we're only talking about a phone call, after all.0

Afternoon All
Just wondered whether anyone had received a similar reply to myself who had been successful / unsuccessful?
Long story short, landed just under six hours late (this year) and the reason was 'Crewing Issues (Captain Shortage)'.
I took a photo of the Thompson paperwork that showed there was a delay, the reason for it, and the instruction to hand out a £5 voucher - This was for the initial two hour delay and they subsequently ran out of vouchers and offered nothing when it came to being a six hour delay.
Anyway, I digress. Letter was sent the day we landed, and this morning I received an email:28 October 2014
Dear michaelbella,
RE: Your flight to Tenerife.
Departure date 31/08/2014. Reference Number *****
Thank you for taking the time to contact us about your flight delay in accordance with EU Regulation 261/2004.
At this time we are experiencing a high volume of correspondence and we apologise for any delay in our response. Please be assured that we have not forgotten about you and we would like to thank you for your on-going patience during this investigation process.

My first reaction is 'it's not a no' but I thought I would ask a few other people. Has anyone else received a similar email, only to be rejected? Or has the first communication received been a rejection?
