I think they are right in there thinking that two years is ample time, shame the law doesnt agree eh thomson,

I dont see it being an issue going forward anyway as its only the backlog has caused the problem
2 years is all well and good in your opinion, but a lot of claimants have had to wait until this point for Huzar clarification despite putting claims in many many years ago. And airlines are known to delay and procrasinate to put a claimant out of time.

Indeed, which is why I said going forward it shouldnt be a problem,

I can see their point in "normal" circumstances two years should be plenty to bring forward a delay claim, not that any claims now out of time should be rejected, just because i can see their point doesnt mean in any way that I think they should have won

In Thomson's last letter, they requested that I contact them again once the outcome of their appeal to the SC was made known. I emailed them today asking that they progress my claim and received their automatic standard reply aiming to get back to me within 28 days.

As they haven't a leg to stand on anymore, I wonder if they'll try to concoct another ridiculous excuse to avoid paying compensation, and dragging this on for years hoping people will give up or run out of time.

I'm looking forward to their response (if I get one). It may take some time though as I'm sure they must be inundated with claims today. Lol.

I have written to Thomson twice regarding a flight delay in 2010 which they both rejected. The last letter was dated 20th October, saying they took it to the Supreme Court and I could write to them again if they loose which they now have done. I have also made an inquiry with Bott & Co. last week, but have not signed anything with them but have submitted the passenger details, do I have to sign a contract with them or do they do everything by email?

Thomson have twice rejected my claim - stating a knock on effect was exceptional circumstances. I twice quoted the relevant court case clearly ruling that a knock on effect doesn't qualify. Thomson says they stand by their refusal & will not respond to any further communication from me. At no time have they cited any other reason for the delay or their refusal to settle. Although they didn't cite the two year rule I thought it best to wait.
As our case is outside the two years I've been waiting for this appeal to be heard. Looks like we're going to court.

Good luck. Get your NBA to them ASAP.
