    Thanks Legal Magpie. How would you go about wording the letter?


    Just something along the lines of 'given the recent rejection of the appeals at the Supreme Court in cases Huzar v Jet 2 and Dawson v Thompson, I request that you now pay my compensation as previously requested in letter referenced ........ I expect payment within 7 days of the date of this letter.


    Something as simple as that or more detail required?
  • That wording is spot on. As I am always mentioning to colleagues, why use 100 words when 20 will do.
  • l had a court date set for july but thomson s asked for a stay till the first of december awaiting the decision of the supreme court as they have lost do i still have to get my paperwork together ready for court or will thomson settle i am a bit in limbo can you help:j
  • Just write to the Court asking for the stay to be lifted. Unless your case really does fall within a genuine extraordinary circumstances, I suspect the Thomson will pay up although it will take them a long time to clear the backlog. If they do offer to settle remember to claim your court costs and interest.

    Thomson (TOM117) Delayed Flight Manchester to Male 27/02/2009
    Hi first time post!.
    We had a delay of 23 Hours and 50 minutes on the 27/02/2009 flying from Manchester (uk) to Male Maldives flight TOM117.
    If I remember correctly we were due to fly at 18.10. A hour or so before the flight was due to take off the departure board changed to delayed. we never saw a Thomson representative not even at the desk. One hour changed to two then four then we were given vouchers for a drink etc.
    Still no information from anybody about our flight.
    What little information we did get was hearsay from other passengers.
    Apparently those passengers in Male Maldives knew about a problem with a flight and they did not return until the next day (Lucky so and so's).
    Thompson then apperantly drafted in another plane and pilot/cabin crew and said we WOULD be flying that evening.
    After a couple more hours delay a plane and crew did arrive only to be told the pilot and flown his Maximum allowed Hours and we would not be flying until the morning 28/02/2009.
    The entire flight and pilot was then told we would be staying at the Radison Blue hotel at the airport.
    After another long wait getting checked in to the hotel we were finally given a room and keycard to enter the room.BUT on using the Keycard and starting to enter the room we became aware that the room was already being used. The room door was answered by a half dressed couple!.
    I returned to reception to complain no Sorry from the help desk just a different room.
    At no time until right near the end of this fiasco did we have any contact with a Thomson Representative or given any clear information about our delay.
    It was our honeymoon and we lost a whole day of our Holiday.
    We wrote to Thomson first off requesting compensation for the one day of our holiday we missed but got the standard generated letter from them refusing to compensate.
    I then tried for delayed flight compensation but again I was "Brick walled" again from Thomsons.
    We never did find out what was the cause of the delay.
    It would be interesting if anybody reading this was on the same flight.
    If you were then please let me know.
    I have now written to Thomson again and asked them to look and reconsider my claim.

    I woud dearly like the CAA to explain why they formulated and published the now discredited Guidelines.
    at the time CAA explained that their best legal advice was that this position was correct in law.
    They need a new lagal team.
    Perhaps outsource to Bott & Co?
